The main classes of business that we are profiling in this month's column are hotels, bars and restaurants. In some instances they are one in the same as one location could contain one or all three of these risks. All will require general liability and some form of property coverage for building and/or contents.

Hotels may have other operations on premises as part of the named insured's business, or as vendors or concessionaires. Those operations could include gift shops, barber/beauty shops, health clubs, limo service, and food establishments. If your client caters to the resort crowd, it is not uncommon to have recreational vendors that offer trail or horseback riding, hiking, water sport rentals, trap and skeet, and snowmobile rental. The hotel is an obvious target, but many agents have problems placing the auxiliary operations. Being able to place coverage for these smaller operations may bring success in acquiring the major account.

Hotels, bars and restaurants also share some of the same underwriting concerns, among which are liquor liability, slips and falls, cooking facilities, and food-borne illness. The hotel's size and focus can add other underwriting concerns to the list. At one time, swimming pools almost put hotels beyond any reasonable pricing until diving boards were removed from the pool area. Underwriters still pay close attention to the pool portion of the risk, looking at fencing, hours of operation, attendants on duty, maintenance of hot tubs and pool rules such as "No glass containers allowed in the pool area." Boilers and heating units need close inspection as well as do sprinkler systems, smoke detectors, and fire extinguishers.

Hotel fires, of course, impact property and lives, and the hotel industry has experienced some major fire losses. The fire at the old MGM Grand in Las Vegas in 1980 resulted in 84 dead and more than 700 injured--and ultimately in the setting of standards for construction, safety equipment, and evacuation procedures for the hotel business. However, the San Juan Dupont Plaza in 1996 left 98 dead and 144 injured.

p66.jpg Hotel employees should be trained in depth on evacuation procedures. What happens at 3 a.m. when the hotel must be evacuated? Calling guests in their rooms will assist but what of the hearing impaired? Elevators will shut down and the stairs must be utilized. Evacuation instructions must be prominently displayed to guide guests to safety.

The type of clientele the hotel caters to will lead to additional concerns. Are convention facilities a large portion of the hotel's business? With extra people, some not guests of the hotel, the exposures to slip and falls, food-borne illness, liquor liability, parking garages/lots and valet parking are turned up a notch. Extra security also will be required.

The financial picture of each of these risks is critical. For example, one-third of restaurants will fail in the first 12 months, half of the remaining the second year, and after five years 80% have been sold or have gone out of business. Hotels need a 65% occupancy rate per year to be profitable. No carrier wants to finance a sale or retirement plan through the fire coverages of the policy. When prospecting in this niche, don't rule out a national chain. Chances are that at least one of these in your town is not a company-owned facility. Several corporations specialize in hotel, motel and restaurant ownership or franchises.

Restaurants have not always enjoyed overall excitement in underwriting circles due to a history of fire losses--which usually are totals. Grease fires are a major factor. Check the grease traps to see that they are emptied on a regular basis. Most carriers will require an automatic fire extinguishing system over the cooking areas. In some ethnic cuisine establishments, tableside cooking is part of the attraction; but it also may cause a fire and injury to customers. Some cities or towns may require a permit for this activity.

Workers compensation underwriters will perk up at the sight of a restaurant submission. Burns, cuts, and slip and falls are commonplace in the bar and restaurant business. Procedures to keep spills of liquids cleaned up will minimize injuries. On-site safety training can impact losses involving the mishandling of hot utensils and sharp instruments. Food handlers need to be schooled in storage of perishables, especially meats, and in how to ward off E-coli type outbreaks. Also track the origin of the produce and meat products in the event of such a problem. This can establish where the source of the infection originated.

Inspection of glassware can eliminate customer injuries. Although the injuries caused by chipped or cracked glassware may be minor, they can be major with a jury. Employee theft in the restaurant/bar business also is a concern. Opportunities can be narrowed if customers pay at the register instead of paying the server. Upscale dining usually will entail coat checks and valet parking, both of which present additional exposures. In many of the hotels and even eating establishments, the display of high-value items such as paintings and sculptures will present the opportunity to provide fine arts coverages. The more opulent the hotel or restaurant, the greater the chances for large glass and sign schedules. This would apply especially in the case of resort locations and upscale eateries.

The bar category ranges from the neighborhood "mom and pop" taverns, to nightclubs, theme clubs, and brew pubs. Coverage needs will include general liability, property, liquor liability and business interruption; but specific coverages such as assault and battery for nightclubs and ATF bonds for brew pubs can be critical. Some policies will have limited assault and battery while others will permit the issuance of the policy without that exclusion. Brew pubs that bottle and sell off premises would also be exposed to product recall which can be obtained as an option with some carriers.

In all cases where employees of the business serve liquor, it is strongly advised to send them to TIPS (training for intervention procedures) which will minimize your liquor liability claims, reduce premiums, and increase acceptability of the risk. Other considerations for bars include satellite dishes, artificially generated current, local ordinance, equipment breakdown, and innkeepers liability. The market for the hospitality niche seems to be very wide and competitive with an abundance of capacity.
