The scope of the contracting field ranges from one-person operations that generate $500 to large general contractors with over $500,000 in premium. Artisans--by far the largest segment of this universe--includes plumbers, electricians, painters, drywallers, carpenters and masons. Many artisan contractors will also serve as sub-contractors for a general contractor on larger projects. Most carriers place them in a BOP policy.
Along with the rest of the economy, the construction industry has experienced expansion. Major construction projects (including roadways) are in full swing in almost every part of the country.
According to a January 1999 report from IMR (Insurance Market Research), of the top ten niche markets in the United States, general contractors/operative builders and plumbing/heating/air conditioning contractors were fourth and tenth respectively. They collectively generate $5 billion in premium. Although numbers in that premium range will attract competition for the business, contractors are not the easiest market to play in. Coverage can be difficult to obtain for some exposures. Audits can be a time-consuming activity, and then collecting additional premium after an audit sometimes can be a problem. Insurers are sensitive to new operations from a financial and experience standpoint. Workers compensation is becoming a difficult placement in several areas, and contractor risks are on that high side of difficulty.
The "Montrose" court decision of 1994 affected the availability of markets, especially in California, which is a huge market for contractors. This decision expanded the exposure insurers had on the risk beyond existing policy periods. Fortunately, this effect has subsided to some degree.
The most recent occurrence concern is exterior insulation finish systems. According to Mike Myers, program director for HEATH Insurance Brokers (Southern California) for residential contracts: "There are two current developments of some interest, one negative and the other positive. The bad news is that contractors that had used EIFS (exterior insulation finish systems) later discovered that it was subject to water intrusion problems. Thus, some carriers now exclude claims related to the installation of EIFS."
Myers continued: "The positive trend is the more frequent videotaping by residential contractors of not only their finished work, but the final walk-through with home purchasers. The videotapes are usually quite helpful in defending lawsuits alleging breach of warranty, misrepresentation, or negligence."
Your client does not need to be an environmental contractor in order to face potential claims. It is important that you are aware of all activities that the client performs. It may be an innocent case of disposing of empty paint cans in a dumpster during disposal of used building materials. If the toxic material contaminates another site, your client is a candidate for a lawsuit. Loss control procedures are a must in controlling and disposing of all materials and chemicals. Anything can be deemed to be a contaminant if it is in the improper environment. Another important thing to keep in mind is that your client is subject to many government agencies. Bringing these exposures to the prospect's attention and offering solutions may very well be the reason he/she needs to make a change in agents.
Most classes are experiencing some level of price and underwriting firming. Contractor risks certainly are no exception. Some reinsurers have withdrawn from carriers writing contractors. Andy Barile, CPCU, president of Arrowhead General Agency's commercial division, confirms that this has taken place. "We expect to see more casualties in the ranks of insurers that neglected to carefully underwrite contractor exposures. We have witnessed MGAs losing their reinsurance support, insurers being forced into liquidation, companies downgraded by A.M. Best, and complete company withdrawal from this class of business. All this relates to being able to take rate increases and manage the negative spread between rising cost and price increase. Retail agents should prepare their contracting insured to pay increases of at least single digits for the general liability coverage."
Barile's opinion is: "Whenever we have pricing improvement for contractors insurance we open ourselves up to competition from the surplus lines insurance carriers, who have acted in a more aggressive manner, undercutting the admitted carriers. Reinsurers of surplus line carriers will need to spend more time revisiting the pricing strategies of these companies, thus enabling us to reap the benefits of contractor insurance price firming."

Surety bonds for contractors are written on the basis of performance, payment, bid, license, permit and other miscellaneous bonds required by local governments. The smaller contractor may need to successfully complete several jobs to show stability and financial management for the risk to be acceptable to some carriers. If you can place the bonds along with the general liability and other coverage you can grow along with your client. Collateral, along with good financial statements, is necessary to write the more difficult bonds that will be required as your client obtains larger projects.
