Business won't be any easier to place this year

What current factors can enter into making your job more difficult? Some markets are disappearing or doing a good job of hiding. The economy is questionable. You are fighting rate increases (that the industry should have taken some time ago). Some carriers even put January renewals on hold until reinsurance treaties could be agreed upon.

Well, let's concentrate on contractors--which even in good times can be a challenge.

Even before September 11, the contractor market was beginning to harden, according to Emerson W. Browne, vice president at Victor Schinnerer & Company. Browne says: "Rates have already increased 5% to 10% with some markets, and others such as Lloyd's are going higher. Many companies are non-renewing and are actually pulling out of the contractor market. They are no longer comfortable with this class of business.

"Currently the major players are Lexington, Zurich, and CNA/Schinnerer. These programs are still strong, though the markets are not introducing new coverages. At this point, it is stability and longevity that will play into the selection process and not just price. More carriers will be quoting both contractors pollution and contractors professional liability. From a risk perspective, it makes sense; and because pollution pricing is relatively inexpensive, many contractors are looking for combined coverage."

Browne continues: "Unfortunately, with recent national events, coverage will be much more restrictive than it has been in the past. Going forward, terrorism exclusions will most likely be a part of all policies. As well, mold exclusions will be included in many policies in areas where this issue is becoming increasingly problematic.

"Exclusions and a hardening market are causing general contractors to rethink their insurance strategy. Buying coverage in the past had been a business practice, with minimal involvement. These days, coverage may be required by the client, leaving no choice. Many contractors, however, are actually choosing to purchase coverage and protect their business even without a design exposure, a smart decision for the future," Browne states.

Contractors will require a more detailed review on your part in the future. Major areas of concern are:

* Insured contracts--are all additional insureds required? To what exposures has the contract obligated your client? Review past policies to see if any additional insured can be eliminated without creating a gap in coverage.

* Have you reviewed the Business Auto Policy for proper symbols of coverage such as both non-owned auto liability and physical damage? Does the insured rent private passenger vehicles or trucks during the year?

* Is aircraft or watercraft rented or chartered to entertain clients--even if only for a day?

* If your insured is involved in a PEO, they have not eliminated all EPLI or employee dishonesty exposures. They are considered a "co-employer."

The current insurance climate will continue to impact all classes of business in the coming years. Some contractors will feel the pinch more than others will.

Mark McCrary, director of marketing for Professional Underwriters, says: "In 2002, we believe the construction industry will continue to undergo major changes. Markets, in general, will tighten and more carriers will withdraw from writing contraction business and especially the high-hazard construction contractors. As reinsurance begins to significantly impact primary carriers, further tightening, re-trenching and withdrawal will occur. We will, no doubt, see significant rate increases continue through 2002." Professional Underwriters' Hard Hat Insurance Program is specifically designed for the medium- to higher-hazard contractors. It includes features such as per-project, per-location aggregate limits, additional insured by contract, agreement or permit.

All is not gloom and doom. The keys to surviving and going forward in the upcoming time will be in the field of research as well as becoming more innovative. Traditional ways of insuring clients will not be the answer.

CNA has designed an agency captive. "CNA agents invited to participate in the program can enjoy a new revenue stream from existing accounts. Relying on each agent's intuition about the business that they currently write, agents are encouraged to 'cherry pick' their best accounts and place them in their captive," according to Steve Bankes, vice president, Captives & Unique Opportunities.

Agents who own the company have the opportunity to share in both the underwriting and investment income on policies they write with CNA and designate for their captive. In addition, agents will continue to earn their normal commissions.
