Special events

Prize indemnification, contests, tournaments and weather coverage

By Larry G. France

Contingency insurance encompasses several types of coverage, not just hole-in-one, which is probably the most common.

The list includes:
Prize indemnification Hole-in-one
Sweepstakes/seeded games Lotteries
Sporting events Non-participant sports events
Guessing games Redemption games/over redemption
Game shows Web-site lotteries
Weather insurance Transmission failure
Event cancellation Non-appearance
Political risk Reduction in yield
Death and disgrace

Let’s look at a few that you may not have heard of—and maybe never will. However, just about the time you make that your mindset, a client will call and ask for coverage.

Transmission failure and preemption protects a client’s television advertising dollars or other revenue should the specific transmission signal that is supposed to send out their ad be interrupted or preempted.

Reduction in yield protects an organization’s bottom line in the event that projected revenue derived from ticket sales or visitors is not reached as a result of a covered peril. Amusement parks and casinos are two common prospects.

Death and disgrace involves the insured individual’s commission of a criminal act or any other act against public interest and/or the individual’s commission of an offensive act against public taste or “decency.” This provision is typically contained as an “out clause” in most sponsor endorsement agreements.

These and other definitions can be found on the North American Contingency Association’s Web site (www.nacaonline.com), along with information on the association and its upcoming 8th annual convention.

Scott Lacroix, executive director of underwriting at IC Group and current president of NACA, says: “NACA brings together an international gathering of the most prominent contingency insurers, reinsurers, brokers and service providers in the world. The three-day conference provides our attendees with wonderful networking and social opportunities, as well as a full day of educational panel discussions. It is a must for those organizations estab-lished in the specialized contingency industry and is an essential calendar date for those looking to expand their product offerings into this niche insurance field.”

Some recent creative promotions include IC Group’s “Catch Syndrome and you could Win $10 Million.” Client SBC Communications’ objective was to promote SBC products and services, increase traffic to the Web site, and gather demographic information while delivering a fun incentive to reward customers. (Syndrome is a character from the movie, “The Incredibles.”)

SCA Promotions worked with a shopping center to boost holiday traffic with a cookie toss into a bowl of milk sitting 20 feet away, with the winner receiving $10,000.

Homebuilders, mortgage companies, realtors and banks have used free mortgage contests to generate loans, increase traffic to open houses and boost response to print, mail and radio advertising.

Some key recommendations for writing special events come from Mark Beck of K&K Insurance:
• Begin early—submit applications well in advance of effective dates to facilitate the best responses from underwriters.
• Provide plenty of information.
• Include as many details as possible in submissions.
• Examine contracts. Obtain for review any contracts entered into by the insured. (Concessions, security and waste removal are examples.)
• Review Additional Insured exposures. What requirements does the insured have for providing additional insured status to other parties?

Don’t forget that some promotions may be held off site with considerable crowds attending the event.

It is also very important to make sure that the policy addresses exposures that special events contain. It may seem a good deal for the insured to extend coverage from existing primary coverage; however, it may not be as extensive as it should be and you also run the risk of depleting policy limits from the primary policy.

Looking to the future: The next three months of specialty articles will include EPLI (June), Personal and Commercial Umbrellas (July), and Trucking (August).

Refer to The Insurance Marketplace Specialty Lines Bulletin Board at www.roughnotes.com for updates on new products, enhancements to existing products, carrier appointments, products not available, contact changes and special interests.
