COUNTRYWIDE

NEW AND REVISED 09 97 MULTISTATE GENERAL LIABILITY ENDORSEMENTS REVISIONS TO CORRESPOND TO THE COMMERCIAL LINES MANUAL CLASSIFICATION TABLE CHANGES

In order to be compatible with and correspond to the new classifications and revisions to the Commercial Lines Manual Classification Table, numerous new general liability endorsements have been developed and current endorsements revised. The following forms are new:

CG 22 87-Exclusion-Adult Day Care Centers

CG 22 88-Professional Liability Exclusion-Electronic Data Processing Services and Computer Consulting or Programming Services

CG 22 89-Exclusion-Property Damage to Electronic Data (Computer Software Manufacturer)

CG 22 90-Professional Liability Exclusion-Spas or Personal Enhancement Facilities

CG 22 91-Exclusion-Telecommunications Equipment or Service Providers Errors and Omissions

The following endorsements have been revised:

GL 22 68-Operation of Customers' Autos on Particular Premises

CG 22 76-Professional Liability Exclusion-Health or Exercise Clubs or Commercially Operated Health or Exercise Facilities

CG 22 77 Professional Liability Exclusion-Computer Data Processing

Listed below, under the individual states, are those that have approved these program changes. This text will not be repeated but will refer back to this Countrywide section.

1997 MULTISTATE REVISIONS TO THE COMMERCIAL AUTO COVERAGE FORMS AND ENDORSEMENTS

Under Physical Damage Coverage-Coverage Extensions, the word "temporary" is added to transportation expense, so only "temporary" transportation expenses are covered after a total theft of a covered vehicle.

Supplementary Payments has been corrected to read "suits against the insured," thus clarifying that the insured, not the suit, is covered. Similar wording is changed in Duties In the Event Of Accident, Claims, Suit or Loss. The maximum daily payment for loss of earnings by the insured has been increased from to $250 to $2,000 per day.

Who Is An Insured has been amended to include limited liability companies (LLC).

Symbol 30 of the Garage coverage form has been amended to use the same definition of what is a customer's auto as in Garagekeepers Coverage Form-CA 99 37. The Excess Coverage option is amended to clarify that the Direct Coverage options are not mutually exclusive of the underlying legal liability coverage. Coverage may apply even when the insured is not legally liable.

In Exclusion #4, Employee Indemnification and Employer's Liability and Exclusion #5-Fellow Employee, a definition has been added for "domestic employee."

Under Physical Damage exclusions, radar or other such equipment has been revised to also exclude any jamming devices.

In Garage Coverage Form-CA 00 05, the Physical Damage exclusion as it relates to an auto dealership now states that there is no coverage for the loss of market value or resale value.

In the condition for Duties In The Event of Accident, Claim, Suit Or Loss, language is strengthened to clarify that the insurer has no obligation until the insured has complied with all duties.

Three new definitions have been added for EMPLOYEE; LEASED WORKER; and TEMPORARY WORKER.

The following new endorsements are added:

CA 20 47-Additional Insured-Lessor of Leased Equipment; CA 20 48-Designated Insured; CA 20 49-Additional Insured - Garages - Grantor of Franchise; CA 23 24-Agricultural Produce Trailers - Seasonal; and CA 23 25-Coverage For Injury To Leased Workers.

Revisions have been made to endorsements as follows:

CA 02 40-Suspension of Insurance: A blank line has been added for insurers to insert a coverage not listed if that coverage may have been suspended by that particular state's law.

UIM may now apply either in combination with UM or stand-alone.

Three other endorsements are also amended accordingly: CA 20 15-Mobile Equipment; CA 20 21-Snowmobiles; and CA 20 27-Registration Plates Not Issued For A Specific Auto.

CA 20 19-Repossessed Autos: Space has been added to show a limit for unlisted locations.

CA 23 17-Truckers-Intermodal Interchange Uniform Endorsement Form UIIE-1: Various changes have been made in response to the Uniform Intermodal Interchange and Facility Access Agreement (UIIA) by the Intermodal Association of North America (IANA).

CA 25 03-False Pretense Coverage: The insured is now required only to take reasonable steps to have a warrant issued. Excluded is coverage if a bank or other drawee fails to pay. Coverage is granted for vehicles on consignment. The reference to a limit of $25,000 is replaced by the amount shown either in the Schedule or in the Declarations.

CA 25 14-Broadened Coverage-Garages: Has been revised to reflect the recent CGL change clarifying that the excluded professional services are health care services. The coverages provided by this endorsement apply only to the non-auto exposures.

CA 99 10-Drive Other Car Coverage-Broadened Coverage For Named Individuals: The mandatory $50 collision deductible has been deleted.

CA 99 28-Stated Amount Insurance: A simple revision has been made to clarify that the stated deductible applies to this endorsement.

CA 99 37-Garagekeepers Coverage and CA 99 59-Garagekeepers Coverage-Customers Sound Receiving Equipment: The Excess Coverage option is amended to clarify that the Direct Coverage options are not mutually exclusive of the underlying legal liability coverage. Further, coverage may apply even when the insured is not legally liable.

NEW 02 97 COMMERCIAL PROPERTY OPTIONAL BUSINESS INCOME ENDORSEMENT

A new optional endorsement, CP 15 56-Business Income Changes-Beginning of the Period of Restoration (No Waiting Period), has been developed; and the appropriate manual and rules changes have been revised to allow for the option of eliminating the 72-hour waiting period now found in the Business Income coverages. Listed below, under the individual states, are those that have approved the new endorsements. This text will not be repeated but will refer back to this Countrywide section.

HOMEOWNERS OPTIONAL LEAD AND ESCAPED LIQUID FUEL ENDORSEMENTS CORRECTED

Typographical errors were found in the endorsements recently approved in many states: HO 05 80, HO 05 81, HO 05 82, and HO 05 83. The errors have been corrected but are not the kinds of changes that require a re-filing with the individual state. The corrected endorsements are replacing the originals and will bear the same edition and effective dates.

ARKANSAS

Commercial Auto Endorsement CA 21 08-Arkansas Uninsured And Underinsured Motorist Coverage has been revised in response to 1997 Ark. Acts (former S.B.271.) The following changes have been made: When the liability insurance carried by the owner/driver of the underinsured motor vehicle is the same as the provider of the insured's underinsured motorist coverage, the matching offer subrogation procedure is made invalid; and if the insured suffers damages from an underinsured motorist, the insured's UIM is triggered when either the liability limits of the policy(s) of the underinsured motorist has been used up or the insurer matches the settlement offer of the insurer of the underinsured motorist. These changes apply to all policies written on or after September 1, 1997.

A revision has been made to Personal Auto Endorsement PP 01 77-Amendment of Policy Provisions-Arkansas as a result of 1997 Ark. Acts (former S.B. 540), based on ARK CODE ANN 5-65-104 as it relates to reasons for termination. The revision in effect says: The insurer cannot cancel or non-renew the policy if the sole reason is an administrative revocation or suspension of the driver's license of an owner or operator of the covered vehicle for operating under the influence of or for the use of alcohol or a controlled substance. This change applies to all policies written on or after October 1, 1997.

COLORADO

CONNECTICUT

DELAWARE

GEORGIA

ILLINOIS

The 1997 Multistate Revisions to the Commercial Auto Coverage Forms and Endorsements have been approved--refer to Countrywide above. These changes apply to all policies written on or after October 1, 1997.

IL 09 17--The Resident Agent Countersignature endorsement has been withdrawn because ILL. REV. STAT. Ch. 215 5/497.2, the law requiring countersignature, was repealed January 1, 1996. IL 09 17 was used for commercial policies and coverage parts including Boiler and Machinery, Commercial Auto, General Liability, Commercial Inland Marine, Commercial Property, and Farm. This change applies to all policies written on or after October 1, 1997.

The new 1997 Homeowners Optional Property Remediation For Escaped Liquid Fuel And Limited Lead And Escaped Liquid Fuel Liability coverage endorsements have been approved. Four new endorsements have been developed to provide home owners with limited first- and third-party coverages for specific pollution hazards. The first-party coverage is for escaped fuel remediation and applies when liquid fuel escapes from its storage system (system must contain a minimum combined capacity of 100 or more U.S. gallons). Up to $10,000 of coverage (a higher limit may be purchased) is provided for temporary repairs to prevent further escape or stop the spread of fuel; expenses to test, monitor, or assess the effects of escaped fuel required by an outside source (other than the insured); additional living expenses; and loss or damage to shrubs, trees, and plants not grown for business. The loss of market value of structure, loss of the actual liquid fuel, or damage from escape of liquid fuel in or for motor vehicles and/or watercraft are not covered.

The third-party coverage applicable to lead and escaped fuel liability coverage actually limits or reduces the insured's protection by capping the limit available to a $50,000 aggregate (higher limits may be purchased) for all claims against the insured from damage or injury because of lead and escaped fuel contamination.

The multistate ISO rules, rates, and forms for Liquor Liability have been withdrawn in Michigan and have been refiled on an advisory basis only. The affected forms that have been withdrawn and are now advisory only are: CG 00 33-Liquor Liability Coverage Form, CG 26 22-Michigan Changes-Liquor Liability, and CG 28 06-Limitation of Insured Premises. These changes apply to all policies written on or after October 1, 1997.

MINNESOTA

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes carry a distribution date of September 1997.

Commercial Auto Endorsement CA 22 25-Minnesota Personal Injury Protection has been revised in response to 1996 Minn. Law (former S.B.1980 Minn. STAT. 65B.47, Subd. 1. a.) In this law, an injured taxi driver--while transporting persons or property--may be covered under the driver's own PIP policy instead of the one covering the taxi. This change carries a distribution date of December 1996.

MISSISSIPPI

MISSOURI

The 1997 Multistate Revisions to the Commercial Auto Coverage Forms and Endorsements have been approved--refer to Countrywide above. These changes apply to all policies written on or after October 1, 1997.

Changes have been made to Commercial Auto Endorsement CA 31 04-Missouri Underinsured Motorists Coverage, as a result of the Missouri Court of Appeals' decision in Zemelman v. Equity Mutual Ins. Co., 935 S.W.2d 673 (Mo. App. 1996). In this decision it was ruled that the UIM coverage purchased by an injured insured was excess to any amount from the tortfeasor and that using the tortfeasor's liability limits as the coverage trigger was unacceptable. The endorsement has been amended accordingly. These changes apply to all policies written on or after December 1, 1997.

MONTANA

NEW JERSEY

The 1997 Multistate Revisions to the Commercial Auto Coverage Forms and Endorsements have been approved--refer to Countrywide above. These changes apply to all policies written on or after October 1, 1997.

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes apply to all policies written on or after September 1, 1997.

Revisions have been made to Commercial Auto Endorsement CA 21 14-New Jersey Uninsured And Underinsured Motorists Coverage to list the circumstances in which an underinsured motor vehicle claim will be paid and clarifying the matching offer subrogation procedures. These changes apply to all policies written on or after October 1, 1997.

NEW MEXICO

The new 02 97 Commercial Property Optional Business Income endorsement has been approved--see Countrywide above. This change applies to all policies written on or after October 1, 1997.

Numerous changes have been made to the Businessowners Program. The 06-89, 12-92, 01-96, and 01-97 multistate revisions have all been approved, including state specific supplements. The revisions are too numerous to elaborate upon here, so careful review is warranted. These changes are applicable to all policies written on or after December 1, 1997.

NEW YORK

NORTH CAROLINA

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes apply to all policies written on or after November 1, 1997.

Approval has been received on the 1994 commercial property changes to the rules, loss costs, forms, and SCOPES filings. These changes include: The base property damage deductible for buildings, personal property, spoilage, and builders' risk has been increased from $250 to $500. A buy-back to the $250 is available. Optional deductibles have been amended to start at $1,000 instead of $500.

Condominium Commercial Unit-Owners Optional Coverage Form CP 04 18 has been revised as follows: Changes in rates were filed to coincide with the increase in the base deductible from $250 to $500. The endorsement provides additional loss assessment coverage subject to a separate schedule and limit, but pays no more than $1,000 for an assessment due to the condominium association's policy deductible. The form also has been revised to allow for the insertion of a deductible for Loss Assessment. Another major change in respect to SCOPES is as follows: The property protection class multipliers have been revised and will now be based on the building construction in addition to the protection class.

The table for Windstorm or Hail Percentage Deductibles has been modified to adjust the ranges of the amount of insurance at each location. This revision was made to complement the deductible changes. The rating examples appendix has been amended to reflect the above changes. These change apply to all policies written on or after November 20, 1997.

NORTH DAKOTA

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes apply to all policies written on or after September 1, 1997.

Amendments have been made to several commercial property and farm endorsements as a result of changes in the 1997 N.D. Laws (former S.B. 1249) which affect the Valued Policy Provisions. When the Valued Policy Provisions do not apply, claims settlement to appurtenant or separate structures will be on an actual cash value or replacement cost basis--whichever applies to the structure. The amended forms include: BP 01 17-North Dakota Changes, CP 01 14-North Dakota Changes, and FP 01 12-North Dakota Changes. These revisions pertain to all policies written on or after October 1, 1997.

OHIO

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes apply to all policies written on or after September 1, 1997.

OKLAHOMA

The 1997 Multistate Revisions to the Commercial Auto Coverage Forms and Endorsements have been approved--refer to Countrywide above. These changes apply to all policies written on or after October 1, 1997.

OREGON

PENNSYLVANIA

RHODE ISLAND

Approved are the new and revised 09 97 Multistate General Liability Endorsements Revisions to correspond to the Commercial Lines Manual classification table changes--refer to Countrywide above. These changes apply to all policies written on or after September 1, 1997.

In response to a recent Rhode Island Supreme Court ruling in Campbell v. Norfolk & Dedham Mutual Fire Ins. Co., 682 A.2d.933 (RI 1996), Homeowners Endorsement HO 01 38-Homeowners Special Provisions Endorsement has been revised to add wording in the Collapse additional coverage to provide coverage for partial collapse of the building if it makes the building uninhabitable. The hidden insect/hidden decay wording has been revised to clarify that it is not covered if the insured is aware of it prior to a collapse.

Several other Rhode Island-specific items have been added or revised in several of the Conditions sections to comply with state law. These changes apply to all policies written on or after September 1, 1997.

The new 1997 Multistate Home Business Insurance coverage optional endorsement, rules, and rates providing first- and third-party coverages for certain types of businesses that are conducted from the residence premises have been approved for all policies written on or after September 1, 1997.

SOUTH DAKOTA
