Approved by individual states through February 1998

By Diana Kowatch, CPCU, AU, AAM, CPIW

CAUTION: Not all insurance companies use ISO forms. Some companies ask ISO to file forms, rules, and loss cost adjustments for them; other companies file for themselves. You will need to find out from each of your companies whether or not revisions or new forms will be adopted, and on what date the form, rule or loss cost adjustments will become effective.

COUNTRYWIDE

Year 2000 Optional Multistate General Liability Endorsements

Four new commercial general liability endorsements have been developed and filed on a multistate basis. The first two are exclusion endorsements. CG 21 60--Exclusion--Year 2000 Computer-Related And Other Electronic Problems has been filed to use with the Commercial General Liability coverage part; and its complement, CG 21 61--Exclusion--Year 2000 Computer-Related And Other Electronic Problems--Products/Completed Operations, has been filed to use with the Products/Completed Operations Liability coverage parts.

Both of these endorsements have been designed to add another exclusion to the list of exclusions that apply to coverage for bodily injury and property damage liability. CG 21 60 also applies to personal and advertising injury liability.

They eliminate bodily injury, property damage, personal injury, and advertising injury liability coverage for loss or injury resulting from any actual or alleged Y2K (failure to recognize a year-date) hardware or software failure or any related advice, consultation, design, evaluation, inspection, installation, maintenance, repair, replacement or supervision.

Two new endorsements have been developed which will allow ISO-based insurers to offer limited Y2K liability coverage. The two endorsements are: CG 04 31--Year 2000 Computer Related And Other Electronic Problems--Limited Coverage Options, to be used with the Commercial General Liability coverage part and CG 04 32--Year 2000 Computer Related And Other Electronic Problems--Limited Coverage Options, to be used with the Products/Completed Operations Liability coverage part.

Both of these endorsements restate the new Y2K liability exclusion previously discussed, so both the exclusion and the coverage should not be used, However, the exclusion does not apply to any coverage or description of products or completed operation that is scheduled. The limited coverage may apply to the coverages of bodily injury or property damage or both. The schedule must contain a description of the product(s) or completed operations that will be covered.

A section has been provided for the insertion of a premium charge for this coverage. However, ISO has not developed any rating for use of these endorsements since no credible statistics are available; thus, all charges will be at the discretion of the insurer giving coverage.

Advisory Policyholder Notices also are available through ISO.

Listed below, under the individual states, are those that have approved the new endorsements. This text will not be repeated but will refer back to this Countrywide section.

Year 2000 Optional Simplified Professional Liability Endorsements

Four new optional simplified professional liability endorsements have been developed and filed on a multistate basis. Two optional endorsements have been developed to provide limited professional liability coverage for scheduled locations, operations, tests, treatments, products or services. They are: PR 04 07--Year 2000 Computer-Related And Other Electronic Problems--Limited Coverage Options, which is available for use with Blood Banks, Diagnostic Testing Laboratories And Hospital Professional Liability coverage parts; and PR 04 08--Year 2000 Computer-Related And Other Electronic Problems-Limited Coverage Options, to be used with Allied Health Care Providers, Optometrists, Physicians, Surgeons and Dentists and Hospital Professional Liability coverage parts.

Two optional exclusion endorsements have been developed and filed to eliminate Y2K coverage. They are: PR 21 04--Exclusion--Year 2000 Computer-Related And Other Electronic Problems, which is to be used with Blood Banks, Diagnostic Testing Laboratories And Hospital Professional Liability coverage parts; and PR 21 05--Exclusion--Year 2000 Computer-Related And Other Electronic Problems, to be used with Allied Health Care Providers, Optometrists, Physicians, Surgeons and Dentists and Hospital Professional Liability coverage parts.

Listed below, under the individual states, are those that have approved the new endorsements. This text will not be repeated but will refer back to this Countrywide section.

Year 2000 Multistate Commercial Property Endorsements

A new mandatory multistate exclusion endorsement has been developed for commercial property, commercial crime, commercial inland marine and boiler and machinery. It is IL 09 35--Exclusion Of Certain Computer-Related Losses. This endorsement is merely a restatement or clarification of what has already been excluded by existing policy language.

A new optional endorsement, CP 15 57--Business Income and/or Extra Expense Coverage For Year 2000 Computer-Related And Other Electronic Problems, has been developed and filed. This endorsement is very different in two important ways from other business income and extra expense coverage. First, business operations do not necessarily have to be suspended for coverage to be triggered. Second, direct physical damage coverage is not required either. The amount of coverage is limited to an annual aggregate of $25,000.

Listed below, under the individual states, are those that have approved the new endorsements. This text will not be repeated but will refer back to this Countrywide section.

The Homeowners Optional Property Remediation For Escaped Liquid Fuel And Limited Lead And Escaped Liquid Fuel Liability Coverage Program

Four new endorsements have been developed to provide homeowners with limited first- and third-party coverages for specific pollution hazards. The first-party coverage is for escaped fuel remediation and applies when liquid fuel escapes from its storage system (system must contain a minimum combined capacity of 100 or more U.S. gallons). Up to $10,000 of coverage (a higher limit may be purchased) is provided for temporary repairs to prevent further escape or stop the spread of fuel; and expenses to test, monitor, or assess the effects of escaped fuel that is required by an outside source (other than the insured); additional living expenses; and loss or damage to shrubs, trees, and plants not grown for business. Not covered is the loss of market value of structure, loss of the actual liquid fuel, or damage from escape of liquid fuel in or for motor vehicles and/or watercraft.

The third-party coverage applicable to lead and escaped fuel liability coverage actually limits or reduces the insured's protection by capping the limit available to a $50,000 aggregate (higher limits may be purchased) for all claims against the insured from damage or injury because of lead and escaped fuel contamination.

Listed below, under the individual states, are those that have approved the new endorsements. This text will not be repeated but will refer back to this Countrywide section.

6-98 Multistate Personal Auto Policy (PAP) Revisions

Numerous revisions have been made to the PAP. The highlights of some of the changes follow. This recap is not "all-inclusive." Please research and evaluate the new forms and endorsements carefully before using.

* The definition of "you" and "your" has been revised to give 90-day temporary coverage to separated spouses and immediate family members while a new residence is being sought.

* Pickups and vans that are leased for at least six months or more are now added to the definition of private passenger type autos.

* A new definition has been added for "newly acquired autos," and the coverage applying to the newly acquired auto will be the broadest coverage of any vehicle currently listed on the policy instead of just the coverage of the vehicle it replaces.

* Defense coverage has been reworded to clarify that once the limit of liability has been exhausted--whether by a settlement or a judgment--defense coverage ceases.

* Loss of earnings under Supplementary Payments is increased from $50 per day to $200.

* With reference to a non-owned pickup or van, previously only those non-owned pickups or vans that were temporary substitutes were covered for business use. Any that was rented or borrowed was not covered. In this new revision, liability for the business use of rented or borrowed non-owned pickups and vans has been added.

* The "reasonable belief" exclusion has been revised so that it no longer applies to a family member while using a covered auto belonging to the insured.

* The nuclear energy exclusion has been revised to update the name of American Nuclear Insurers to Nuclear Energy Liability Insurance Association.

* Liability protection for non-owned golf carts has been added.

* The limits of liability for Part A--Liability coverage, Part C--Uninsured Motorist coverage and for Underinsured Motorists coverage will now be on a split limits basis.

* With respect to both the Uninsured Motorist coverage and Underinsured Motorists coverage, the Other Insurance provision has been revised to clarify that the PAP will be on an excess basis over any other collectible UM or UIM (or other similar type coverage) not over any other automobile coverage.

* The coverage built into the policy for temporary transportation expenses has been increased to $20 per day with a $600 maximum.

* Physical Damage coverage for permanently installed telephones is added, and the sub-limit for after-market sound reproducing equipment is increased to $1,000. That amount can be increased, for an additional premium.

Again, the items listed above are only highlights of some, not all, of the changes and revisions. Listed below, under the individual states, are those that have approved the new program. This text will not be repeated but will refer back to this Countrywide section.

MINNESOTA

Personal Auto Endorsement PP 04 97--Uninsured/Underinsured Motorists Coverage--Minnesota has been revised in response to the decision in Ronning v. Citizens Security Mutual Insurance Company, 557 N.W.2d 363 (Minn. Appl. 1996). In that decision, it was ruled that the governmental vehicle exception in the definition of an uninsured or underinsured motor vehicle was against public policy, so the definition in the endorsement has been amended accordingly to remove the exception. This change applies to all policies written on or after May 1, 1998.

Commercial Auto Endorsement CA 21 24--Minnesota Uninsured And Underinsured Motorists Coverage has been similarly endorsed. In addition, other changes have been made to the endorsement. In response to a decision in Malmin v. Minnesota Mutual Fire & Casualty Company, 552 N.E.2d 723 (Minn 1995), where the Consent to Sue clause was ruled to violate The Minnesota No-Fault Act, the insured does not need to have the written consent of the insurer but must give reasonable notice and opportunity to protect the insurer's interest. Further, both parties must agree to any arbitration. If the limits provided for the coverage are on a combined single-limit basis, the limit available to any one person cannot be less than the minimum per person mandated in Minnesota law. Finally, the rights of the insurer with respect to subrogation are limited in their application against any entity insured under the policy or any other policy issued by that insurer. These changes will carry a distribution date of June 1, 1998.

Revisions have been made to Commercial Auto Endorsement CA 02 18--Minnesota Changes--Cancellation And Nonrenewal Endorsement, as a result of MINN.STAT. 65B.15, subd. 1 and 60A.36, subd. 1. The changes reflect that any cancellation of coverage because of a suspension or revocation of a license may only be because of a moving traffic violation or a person's refusal to be tested for "under the influence." In the provision explaining the process of any appeal resulting from cancellation, the commissioner's time to reply has been extended from 5 to 30 days. Finally, the revisions clarify that proof of mailing of any notice shall be sufficient proof of notice. These changes carry a distribution date of August 1, 1998.
