ISO FORM AND
ENDORSEMENT CHANGES

Approved by individual states through September 1998

CAUTION: Not all insurance companies use ISO forms. Some companies ask ISO to file forms, rules, and loss cost adjustments for them; other companies file for themselves. You will need to find out from each of your companies whether or not revisions or new forms will be adopted, and on what date the form, rule or loss cost adjustments will become effective.

COUNTRYWIDE

1998 General Liability Multistate Forms Revisions

Pollution

A new exception to the pollution exclusion has been added which now provides coverage for injury or damage that results from the release of gases, fumes or vapors from materials that have been brought into a building in connection with operations performed by or on behalf of the insured. Items such as paint, cleaning solvents, chemical treatments or carpet/tile glue that are brought into a building by the insured or a contractor of the insured, and are used to repair or service the building, no longer are excluded. Another important exception to the exclusion is that if property damage to a third party is covered by the policy, any resultant cleanup claims also will be covered.

Personal and Advertising Injury Liability

There is now one combined definition for personal and advertising injury liability. Two advertising injury offense definitions have been amended. The first on misappropriation of advertising ideas or style of business has been changed to: "The use of another's advertising idea in your 'advertisement.'" The second on infringement of copyright, title or slogan has been rewritten to: "Infringing upon another's copyright, trade dress or slogan in your 'advertisement.'" Bodily injury that is suffered as a consequence of a covered personal and advertising injury offense is now covered. The exclusion regarding willful violation of a penal statute or ordinance has been replaced with the exclusion that simply states: "Arising out of a criminal act committed by or at the direction of any insured." A new exclusion is added. It eliminates personal and advertising injury coverage for insureds in the business of advertising, broadcasting, publishing or telecasting.

Advertisement is now a defined term.

Coverage for Damage to Premises Rented to an Insured

An exception to the property damage exclusion (j.) has been added which gives premises liability coverage including contents of the premises for property of others at a location the insured is renting for seven consecutive days or less.

Other Changes

Changes to other liability programs have been made to reflect the above CGL revisions. Numerous endorsements also have been amended accordingly. Time and attention should be given to analyses of the overall impact of this revision upon an individual insured.

Declarations Pages for General Liability Coverage Parts

The declarations pages for the various general liability coverage forms have been updated with respect to the limits of insurance to reflect the change in title from Fire Damage Limit of Insurance to the new title: Damage To Premises Rented To You Limit.

Listed below, under the individual states, are those that have approved the above programs or revisions. The text will not be repeated but will refer back to the specific Countrywide section.

Changes Made by Individual States
ALABAMA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

In response to the Alabama Department of Insurance Bulletin of March 5, 1998, regarding the Approval of Arbitration Agreements/Departmental Guidelines and Requirements, Personal Auto Endorsement PP 04 31--Uninsured Motorists Coverage--Alabama has been revised accordingly. These changes apply to all policies written on or after November 1, 1998.

ALASKA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Optional Multistate Year 2000 new, additional and/or revised Businessowners, Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been approved. These changes apply to all policies written on or after November 1, 1998, for all lines of business except businessowners and December 1, 1998, for businessowners.

ARIZONA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

ARKANSAS

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

The 1998 Personal Auto Policy Program has been approved including state-specific endorsements. This change applies to all policies written on or after September 1, 1998.

Optional Multistate Year 2000 new, additional and/or revised simplified Professional Liability, Commercial General Liability, Garage, Businessowners, Boiler and Machinery, Commercial Fire, Commercial Inland Marine and Commercial Crime endorsements have been approved. These changes apply to all policies written on or after November 1, 1998. The optional Homeowners and Dwelling Liability endorsement for home business has been disapproved.

The Arkansas Insurance Department has issued a directive 2-98, dated July 21, 1998, containing information and the use of Year 2000 endorsements for commercial policies.

CALIFORNIA

Optional Multistate Year 2000 endorsements have been approved for use with the Garage coverage form. These changes are approved for ISO participating insurers as of July 30, 1998.

COLORADO

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes carry a distribution date of December 1998.

DELAWARE

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

As a result of changes to Delaware Law--1997 Del. Laws (former Senate Bill 288), the cancellation provision in Commercial Auto Policy Endorsement PA 02 55--Delaware Cancellation Changes, regarding when a policy cannot be canceled for youthful drivers, has been revised accordingly. These changes apply to all policies written on or after December 1, 1998.

The defense provision in Homeowners Endorsement HO 01 07--Special Provisions--Delaware has been revised to clarify its original intent as a result of Continental Ins. Co., v. William, No. 287, 1997. In this case, the insurer paid the entire policy limit up front, but the courts ruled that the insurer still owed a duty to defend. The revisions clarify that once the policy limit has been paid, the insurer's obligations to defend end. These changes apply to all policies written on or after December 1, 1998.

FLORIDA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies effective on or after February 1, 1999.

In response to 1997 Florida Law (former H.B. 3597), which specifies the reasons an insurer may reject, cancel or nonrenew a residential property with home day care exposure, a new homeowners endorsement has been developed. The new endorsement, HO 25 11--Home Day Care Coverage Endorsement, explains the reasons, such as caring for more children than authorized, failure to maintain separate CGL or other applicable liability coverage, failure to comply with day care licensing or registration requirements or willful/gross negligence. These changes apply to all policies effective on or after November 1, 1998.

To comply with FLA. STAT 627.732, 627.736 and 409.910, changes have been made to two personal auto policy endorsements by amending the definition of motor vehicle to allow occupants of public school transportation the ability to recover personal injury protection benefits in personal auto policies. The two revised endorsements are: PP 05 54--Personal Injury Protection Coverage--Florida, and PP 05 55--Added Personal Injury Protection Coverage--Florida. In both of the mentioned endorsements and in PP 05 66--Extended Personal Injury Protection Coverage--Florida, the PIP/Medicaid offset has been eliminated. These changes apply to all policies effective on or after December 1, 1998.

Business auto endorsements also have been revised to reflect the commercial equivalent of the personal injury protection change. The revised endorsements are: CA 22 10--Florida Personal Injury Protection; CA 22 11--Florida Added Personal Injury Protection; and CA 22 50--Florida Extended Personal Injury Protection. These changes apply to all policies effective on or after January 1, 1999.

Optional Multistate Year 2000 new, additional and/or revised simplified Professional Liability, Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been approved. These changes apply to all policies effective on or after December 1, 1998.

Note that Florida has issued an informational memorandum, 98-107M, regarding the filing and use of Year 2000 endorsements.

GEORGIA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Revisions have been made to Homeowners Endorsement HO 01 10--Special Provision--Georgia, as a result of the decision reached in Allstate Ins. Co. v. Justice, 493 S.E.2d 532 (Ga App. Ct. 1997). Because of this case, the exclusion regarding expected or intended damage or injury has been revised to further clarify its intent. This change applies to all policies written on or after November 1, 1998.

Homeowners Endorsement HO 01 10--Special Provision--Georgia has been revised with reference to the Additional Coverage of Collapse. As new types of construction are introduced, such as Exterior Insulation and Finish Systems (which appears to allow water seepage that ultimately damages the structural integrity of the building), the Collapse cause of loss has been interpreted in the courts as providing coverage for this type of loss. Accordingly, policy language has been revised to clarify that it is not the intent of the insurance contract to cover this loss. These changes apply to all policies written on or after February 1, 1999.

Optional new Multistate Year 2000 Homeowners endorsements for business coverage have been approved for all policies written on or after November 1, 1998.

HAWAII

Optional Year 2000 revised Commercial Inland Marine endorsements have been approved. These changes carry a distribution date of October 1998.

IDAHO

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

ILLINOIS

A new commercial policy change endorsement has been approved to replace the prior endorsement that previously had been withdrawn. The new endorsement is IL 12 01--Policy Changes. This change applies to all policies written on or after December 1, 1998.

Note that Illinois has issued Bulletin CB 98-6, regarding the filing and use of Year 2000 endorsements.

Optional new, additional and/or revised Multistate Year 2000 Commercial General Liability, Businessowners, Garage, Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been approved for all policies written on or after November 1, 1998, on condition that the endorsements be used in accordance with the April 6, 1998 Departmental Directive.

INDIANA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

IOWA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after February 1, 1999.

Personal Auto Endorsement PP 01 98--Amendment of Policy Provisions--Iowa has been revised as a result of the case of United Fire and Casualty Co. v. Victoria, 576 N.W. 2d118 (Iowa 1998). The termination provision has been amended as it was determined to be ambiguous. This change applies to all policies written on or after December 1, 1998.

Optional new, additional and/or revised Multistate Year 2000 Commercial General Liability, Garage, Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been approved on condition they are used in accordance with the May 29, 1998 Bulletin 98-02. These changes apply to all policies written on or after October 1, 1998. Multistate Year 2000 simplified Professional Liability endorsements also have been approved for all policies written on or after November 1, 1998.

KANSAS

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

KENTUCKY

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Note that Kentucky has issued a Departmental Directive on July 21, 1998, regarding the filing and use of Year 2000 endorsements.

LOUISIANA

Optional new, additional and/or revised Multistate Year 2000 Businessowners, Garage, Commercial General Liability, Boiler and Machinery, Commercial Fire, Commercial Inland Marine and Commercial Crime endorsements have been approved on condition they are used in accordance with the July 31, 1998 Bulletin LIRC 98-04. These changes apply to all policies written on or after December 1, 1998.

MARYLAND

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies effective on or after February 1, 1999.

MASSACHUSETTS

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

In response to the decision in Rich v. Great American Insurance Company, 481 Mass. 651, 881 N.E.2d 69 (1993), the definition of collapse has been revised in Homeowners Endorsement HO 01 20--Special Provisions--Massachusetts. These changes carry an 08 98 edition date.

MICHIGAN

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Michigan has approved the new commercial Common Policy Declarations IL DS 00 for all policies written on or after December 1, 1998.

MINNESOTA

The 1998 Revisions to the Multistate Interline Endorsements have been approved along with a state-specific supplement including Endorsement IL 02 45--Minnesota Changes--Cancellation and Nonrenewal. These changes apply to all policies written on or after December 1, 1998.

The Simplified Multistate Professional Liability Forms and Endorsements have been approved along with a state-specific supplement including Endorsement PR 01 14--Minnesota Changes. These changes apply to all policies written on or after December 1, 1998.

The new, multistate Employment-Related Practices Liability Program and state-specific endorsement (EP 26 01-Minnesota Changes) have been approved with a distribution date of December 1998.

Optional new multistate Year 2000 simplified Professional Liability endorsements have been approved for all policies written on or after December 1, 1998.

MISSISSIPPI

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

MISSOURI

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Because of differences between the ISO version and the SAA (Surety Association of America) version of Commercial Crime Endorsement CR 01 27--Missouri Changes, ISO has re-filed its version with a different edition date. This change applies to all policies written on or after October 1, 1998.

Medical expense payment provisions in the two commercial endorsements: revised BP 01 11--Missouri Changes and new CG 26 50--Missouri Changes--Medical Payments have been modified or newly developed to clarify that in Missouri, insurers cannot deny a claim solely because written notification was not received within a specified period of time unless that failure prejudices the rights of the insurer. These changes apply to all policies written on or after December 1, 1998.

MONTANA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes carry a distribution date of December 1998.

NEBRASKA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Optional new Multistate Year 2000 Garage (on condition that Endorsement CA 25 20 be withdrawn), Boiler and Machinery, Commercial Fire, Commercial Inland Marine, Commercial Crime, Businessowners and Homeowners endorsements for business coverage have been approved for all policies written on or after November 1, 1998.

NEVADA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Personal Auto Endorsement PP 01 82--Amendment of Policy Provisions--Nevada, has been revised in response to Nevada Supreme Court decision in Alamo Rent-A-Car v. State Farm Auto, Ins. Co. and Valley Forge Ins. Co., Nev. P.2d, (1998). The change makes the personal auto liability policy of a renter of a vehicle primary over the liability policy of the rental agency. This change applies to all policies written on or after December 1, 1998.

Optional new, additional or revised Multistate Year 2000 simplified Professional Liability endorsements for business coverage have been approved for all policies written on or after November 1, 1998.

NEW HAMPSHIRE

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

New and amended state-specific endorsements regarding the Year 2000 issues have been developed for boiler and machinery, commercial fire, commercial inland marine, commercial crime and businessowners coverages. These changes apply to all policies written on or after November 1, 1998.

NEW JERSEY

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Two new commercial endorsements have been developed to comply with New Jersey law regarding liability for lead contamination--it cannot be excluded from pollution. Thus, exceptions to the multistate policy exclusions have been designed. The new endorsements are: BP 04 72--New Jersey Changes--Coverage For Liability For Hazards of Lead (for businessowners policies); and CG 26 492--New Jersey Changes--Coverage For Liability For Hazards of Lead (commercial general liability). These changes apply to all policies written on or after November 1, 1998.

The Homeowners Optional Property Remediation For Escaped Liquid Fuel And Limited Lead And Escaped Liquid Fuel Liability Coverage Program has been disapproved.

The Homeowners HO 01 29--Special Provisions--New Jersey has been revised regarding the expected or intended exclusion and to whom it applies. These changes apply to all policies written on or after December 1, 1998.

The new, optional Home Business Insurance Coverage Endorsement--HO 05 90, and revisions to HO 01 29--Special Provisions Endorsement for homeowners policies have been approved and apply to all policies written on or after December 1, 1998.

NEW MEXICO

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

NORTH CAROLINA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies effective on or after February 1, 1999.

NORTH DAKOTA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

OHIO

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Revisions have been made to Commercial Auto Endorsement CA 01 05--Ohio Changes to comply with Ohio Rev. Code Ann. Sec. 4509.53 and the Ohio Insurance Department regarding "conditions precedent" language. These changes apply to all policies written on or after December 1, 1998.

OKLAHOMA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

OREGON

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

PENNSYLVANIA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Change has been made to Homeowners Endorsement HO 01 37--Special Provisions--Pennsylvania, as a result of two court cases: London et al. v. Placement Facility of Pennsylvania, 1997 WL 718678 (PA. Super. 11/10/97); and Farber v. Perkiomen Mutual Ins. Co., 370 PA. 480, 88 A.2d 776. This revision clarifies the application of Actual Cash Value (the cost to repair or replace with material of like kind and quality minus deduction for deterioration, depreciation and obsolescence). This change applies to all policies written on or after December 1, 1998.

Four commercial auto endorsements have been revised in response to Lamar v. Colonial Penn Ins. Co., 396 PA. Super. 527, 528 A2d 1337, regarding uninsured and underinsured motorists coverage. The revised endorsements include:

CA 21 06--Pennsylvania Uninsured Motorists Coverage--Stacked

CA 21 91--Pennsylvania Underinsured Motorists Coverage--Stacked

CA 21 92--Pennsylvania Uninsured Motorists Coverage--Nonstacked

CA 21 93--Pennsylvania Uninsured Motorists Coverage--Nonstacked

These changes apply to all policies written on or after November 1, 1998.

PUERTO RICO

Two significant personal auto endorsements: PP 01 70--Amendment of Policy Provisions--Puerto Rico, and IL 09 01--Compulsory Liability Insurance Policy Notice--Puerto Rico have been translated into Spanish and approved for use. These changes apply to all policies on or after November 1, 1998.

Optional Multistate Year 2000 new, additional and/or revised Commercial General Liability, Garage, Boiler and Machinery, Commercial Fire, Commercial Inland Marine, Commercial Crime and Businessowners endorsements have been approved. These changes apply to all policies effective on or after December 1, 1998.

RHODE ISLAND

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

In response to the case of Claude v. Continental Insurance Co., 708 A.2d. 190 (R.I. 1998), the multistate Personal Auto PP 03 26--Liability Coverage Exclusion endorsement has been withdrawn. This change applies to all policies written on or after October 1, 1998.

SOUTH CAROLINA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

The 1995 Commercial Property Program with 1997 Classification Table revisions has been approved. Included in the approval are state-specific commercial property endorsements, a revised Individual Risk Premium Modification Plan and revised loss costs. These changes apply to all policies written on or after November 1, 1998.

The 06/98 Personal Auto Policy Program has been approved with loss costs and state-specific amendments. This change applies to all policies written on or after November 1, 1998.

SOUTH DAKOTA

The Appraisal Provision in Homeowners Endorsement HO 01 40--Special Provisions--South Dakota has been revised to make appraisal optional and non-binding. This change applies to all policies written on or after December 1, 1998.

Optional new Multistate Year 2000 Businessowners endorsement has been approved. These changes apply to all policies written on or after October 1, 1998.

TENNESSEE

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

TEXAS

Optional Year 2000 Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been disapproved in Texas; however, the new optional and additional General Liability endorsements have been found acceptable. Effective dates are not established in Texas.

UTAH

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Homeowners Endorsement HO 01 43--Special Provisions--Utah has been revised to clarify the coverage and intent of the Additional Coverage--Collapse as a result of American Concept v. Jones, 935 F. Supp. 1220 (D. Utah 1996). These changes apply to all policies written on or after October 1, 1997.

New Homeowners Endorsement HO 25 12--Watercraft--Utah has been developed to respond to 1997 Utah Laws (former S.B. 52), section 31A-22-1503, which creates compulsory financial responsibility requirements for owners and operators of personal watercraft. The new endorsement excludes coverage for personal watercraft defined in the Utah Insurance Code. These changes apply to all policies written on or after November 1, 1998.

VERMONT

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Optional Multistate Year 2000 new, additional and/or revised Boiler and Machinery, Commercial Fire, Commercial Inland Marine, and Commercial Crime endorsements have been approved. These changes apply to all policies written on or after October 1, 1998.

VIRGINIA

Homeowners Endorsement HO 23 54--Earthquake--Virginia has been revised to reflect changes in earthquake territories (now zip-code based), loss costs, rules and deductible provisions. These changes apply to all policies effective on or after August 1, 1998.

The Homeowners Optional Property Remediation For Escaped Liquid Fuel And Limited Lead And Escaped Liquid Fuel Liability Coverage Program has been disapproved.

WASHINGTON

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

The Commercial General Liability Program for Underground Storage Tanks (USTs) has been approved for implementation. This change applies to all policies written on or after December 1, 1998.

WEST VIRGINIA

The 1998 General Liability Multistate Forms Revisions have been approved including state-specific supplements. Refer to the Countrywide section. These changes apply to all policies written on or after December 1, 1998.

Interline Endorsement IL 02 81--West Virginia--Cancellation has been revised in order to also apply to the Simplified Professional Liability Program and the Employment Related Practices Liability coverage part. This change applies to all policies written on or after November 1, 1998.

Personal Auto Endorsement PP 04 53--Uninsured/Underinsured Motorists Coverage--West Virginia has been revised with respect to the definition of insured, in response to the case of Adkins v. The commercial auto counterpart affects Endorsement CA 21 22--West Virginia Uninsured and Underinsured Motorists Coverage which has been revised accordingly. This change applies to all policies written on or after December 1, 1998.
