COUNTRYWIDE

Revised Common Policy Conditions for Commercial Lines Coverage Parts

Commercial Lines Common Policy Conditions-IL 00 17 has been revised. It clarifies that while the condition regarding inspections, surveys, reports or recommendations does not warrant that such conditions are safe, healthful or comply with laws, codes or regulations, there is one exception. If the inspection or survey pertains specifically to the certification of boilers, pressure vessels or elevators, under state or municipal statute, the condition does not apply.

Listed below, under the individual states, are those that have approved the new program. This text will not be repeated but will refer back to this Countrywide section.

Additional New Year 2000 Businessowners Program Endorsements

Two additional endorsements have been developed to add more flexibility in addressing the Year 2000 problem. They are:

ARIZONA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

ARKANSAS

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

CALIFORNIA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. These changes may be used as of June 5, 1998, for ISO participating insurers.

The additional Year 2000 General Liability Program endorsements have been approved-refer to the Countrywide sections above. These changes were approved as of July 10, 1998, for ISO participating insurers.

COLORADO

Two recent court cases, Allstate Insurance Company v. Avis Rent-A-Car, Inc. 947 P.2d 341 (Colo. 1997), December 2, 1997 and Huizar v. Allstate Insurance Company, 952 P.2d 342 (Colo. 1998), have resulted in revisions to two personal auto endorsements: PP 01 61-Amendment of Policy Provisions-Colorado and PP 04 25-Uninsured Motorists Coverage-Colorado. In the first case (Allstate v. Avis), the ruling led to the revision to the Other Insurance clause. The ruling in this decision held that when more than one excess clause applies to a loss and these excess clauses conflict, the loss will be apportioned between the insurers on an equal primary basis up to the policy limits of the responding policies until the loss is either compensated or the limits of one of the policies have been exhausted. The remaining policy(ies) continue coverage until the entire loss is compensated or the limits are used up. In the second case (Huizar v. Allstate), the language in the Arbitration provision which allows either party to demand a trial after arbitration has concluded if the arbitration award exceeds the financial responsibility limits of this state, has been removed. These revisions carry an October 1998 distribution date.

The revised Multistate Commercial Property Year 2000 endorsements have been approved-refer to the Countrywide section above. These changes carry a distribution date of October 1998.

The additional new Simplified Professional Liability Programs endorsements have been approved-refer to the Countrywide section above. Neither effective nor distribution dates are determined for Professional Liability in Colorado.

CONNECTICUT

The additional new Year 2000 General Liability Program endorsements have been approved-refer to the Countrywide sections above. These changes apply to all policies effective on or after November 1, 1998.

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies effective on or after January 1, 1999.

DELAWARE

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

DISTRICT OF COLUMBIA

The additional new Year 2000 General Liability Program endorsements, the additional new Simplified Professional Liability Programs endorsements, the Year 2000 optional Multistate Garage Coverage endorsements and the revised Multistate Commercial Property Year 2000 endorsements have been approved-refer to the Countrywide sections above. These changes apply to all policies written on or after October 1, 1998.

FLORIDA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies effective on or after January 1, 1999.

The Year 2000 Optional Multistate Homeowners Business Coverage endorsements and the Year 2000 Optional Multistate Garage Coverage endorsements have been approved-refer to the Countrywide sections above. These changes carry a distribution date of December 1998.

The Multistate Employment-Related Practices Liability Program (discussed in numerous past magazine issues) with Florida-specific supplement has been approved. The state-specific supplement includes EP 02 01-Florida Changes-Cancellation and Nonrenewal. These changes apply to all policies effective on or after October 1, 1998.

The new and additional Year 2000 Optional Multistate Businessowners endorsements and the new (discussed in several previous columns) and additional Year 2000 General Liability Program endorsements have been approved-refer to the Countrywide sections above. These changes apply to all policies effective on or after December 1, 1998.

The Multistate Employment-Related Practices Liability Program (discussed in numerous past magazine issues) with Florida-specific supplement has been approved. The state-specific supplement includes EP 02 01-Florida Changes-Cancellation and Nonrenewal. These changes apply to all policies effective on or after October 1, 1998.

GEORGIA

IDAHO

ILLINOIS

INDIANA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

IOWA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

The new and additional Year 2000 Optional Multistate Businessowners endorsements and the Year 2000 Optional Multistate Homeowners Business Coverage endorsements have been approved-refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998.

KANSAS

Three personal auto endorsements have been revised to comply with K.S.A.5-401 (b.)(c.)(1.) and the decision reached in Friday v. Trinity Universal of Kansas, 924 P.2d 1284 (Kansas 1997) where it is clear that the appraisal provision is a type of arbitration and, thus, cannot apply to insurance contracts. The appraisal condition is voluntary for both parties; both must agree to the process and the results are not binding. The applicable endorsements are: PP 01 56-Amendment Of Policy Provisions-Kansas, PP 04 57-Uninsured Motorists Coverage-Kansas and PP 05 64-Personal Injury Protection-Kansas. These changes apply to all policies written on or after October 1, 1998.

The Year 2000 Optional Multistate Homeowners Business Coverage endorsements have been approved-refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998.

KENTUCKY

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

MARYLAND

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies effective on or after January 1, 1999.

The Year 2000 Optional Multistate Homeowners Business Coverage endorsements have been approved-refer to the Countrywide sections above. These changes apply to all policies effective on or after November 1, 1998.

MASSACHUSETTS

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

MICHIGAN

ISO indicates that due to error, the Professional Liability endorsement, PR 01 36-Michigan Changes Endorsement, was not submitted for approval nor was it approved for use. It is no longer available and all usage should be discontinued.

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

The additional new Simplified Professional Liability Programs endorsements have been approved-refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998.

MINNESOTA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

The Year 2000 Optional Multistate Garage Coverage endorsements have been approved--refer to the Countrywide sections above. These changes apply to all policies written on or after September 1, 1998.

MISSISSIPPI

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. Commercial inland marine carries a distribution date of November 1998, and the remaining coverage part changes apply to all policies written on or after November 1, 1998.

The revised Multistate Commercial Property Year 2000 endorsements have been approved-refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998, for boiler and machinery and crime policies. For commercial inland marine, a distribution date of October 1998 applies.

MISSOURI

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

MONTANA

NEBRASKA

NEVADA

The Year 2000 Optional Multistate Garage Coverage endorsements and the new and additional Year 2000 Optional Multistate Businessowners endorsements have been approved- refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998.

NEW HAMPSHIRE

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. Also revised is Businessowners Program Common Policy Condition in BP 01 13-New Hampshire Changes. These changes apply to all policies written on or after November 1, 1998.

NEW JERSEY

The Year 2000 Optional Multistate Garage Coverage endorsements have been approved-refer to the Countrywide section above. These changes apply to all policies written on or after October 1, 1998.

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. Commercial inland marine and boiler and machinery carry a distribution date of November 1998, and the remaining coverage part changes apply to all policies written on or after November 1, 1998.

Endorsement PP 03 75-Rating Information-New Jersey has been introduced to provide personal auto classifications currently in effect in New Jersey in response to Regulation N.J.A.C. 11:3-9.1 regarding rating information for private passenger automobile insurance. This change applies to all policies written on or after September 1, 1998.

NEW MEXICO

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

The additional new Year 2000 General Liability Program endorsements, the Year 2000 Optional Multistate Garage Coverage endorsements and the revised Multistate Commercial Property Year 2000 endorsements have been approved-refer to the Countrywide sections above. These changes apply to all policies written on or after October 1, 1998.

The additional new Year 2000 Businessowners Program endorsements, the additional new Year 2000 Optional Multistate Businessowners endorsements, the Year 2000 Optional Multistate Homeowners Business Coverage endorsements and the additional new Simplified Professional Liability Programs endorsements have been approved-refer to the Countrywide sections above. NEW YORK

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies written on or after November 1, 1998.

In response to 1997 NY Laws (former Assembly Bill 7728-A0), changes have been made to two personal auto endorsements. These endorsements have been amended to apply to both uninsured and underinsured motorists coverage instead of just uninsured. Changes include title revisions and insuring agreement amendments. The revised endorsements are: PP 04 09-Supplementary Uninsured/Underinsured Motorists Endorsement-New York and PP 04 10-Split Supplementary Uninsured/Underinsured Motorist Limits-New York. These changes apply to all policies written on or after October 1, 1998.

The commercial auto version of the above change also has been approved. The revised forms are: CA 31 07-New York Supplementary Uninsured/Underinsured Motorists Endorsement and CA 31 08-New York Split Supplementary Uninsured/Underinsured Motorists Limits. These changes apply to all policies written on or after November 1, 1998.

NORTH CAROLINA

The revised Common Policy Conditions for Commercial Lines Coverage Parts has been approved. Refer to Countrywide above. This change applies to all policies effective on or after January 1, 1999.

NORTH DAKOTA

OHIO

CAUTION: Not all insurance companies use ISO forms. Some companies ask ISO to file forms, rules, and loss cost adjustments for them; other companies file for themselves. You will need to find out from each of your companies whether or not revisions or new forms will be adopted, and on what date the form, rule or loss cost adjustments will become effective.
