Not far from our office, Bank "A" recently constructed a new facility adjacent to its existing location. When that was completed and they occupied the new building, speculation grew as to who would move into the perfectly good existing structure. When demolition started, a parking lot was the front-runner in many minds. Wrong. Bank "B" constructed a new branch on the old site. This had to be a contractor's dream. This operation entailed demolition, masonry, asphalt, carpentry, roofing, tile, vault and landscape contractors to name a few.
In researching this article, we surveyed 17 different listing categories under contractors in the 1999 edition of The Insurance Marketplace, ranging from artisan contractors to X.C.U. liability. Some 51 sources of coverages responded and are listed following this introduction. Note that some are markets for surety coverages, some general liability, and others will provide both.
Artisan contractors represent a less complicated segment of the contractors class and are usually relatively small operations performing low exposures such as carpentry. They may consist of only the owner and part-time help.
Larger operations, especially ones that work on government projects such as municipal sites, roads, and schools, don't require liability coverages but will have a constant need for surety bonds such as contract, bid, supply, maintenance or performance bonds. Unless you work with contractors on a daily basis, the request for a bond of any kind can send panic throughout the office. Who writes this type of bond? What limits are available? What bond fits the client's needs? Do we need financials? The bond markets will guide you through this process. An accurate picture of the contractor's financial status is a must. Balance sheets, P&L statements, or financial statements will probably be required depending on the type and limit of the bond. Has the client performed this type of work previously? Were those jobs as large in scope? Were they in the client's area of expertise? Prepare to obtain answers to similar questions from an underwriter.
When working with a prospect that is a specialty contractor such as crane, environmental, material handling, or steel erection, you will need to consult markets that have expertise in underwriting, policy language, loss control, and pricing flexibility. It is unlikely that a "shelf product" will secure a sale of this type.
Other coverages that will deserve consideration in most instances are D&O, installation floaters, E&O, license and permit bonds, equipment floaters, and GAP--and don't forget Y2K. Each carrier will have different insuring agreements and conditions, so review them in depth with the underwriter prior to presentation or placement. Check policies for a "Montrose Exclusion." It states that an insurer could be held liable for damages which occurred prior to its policy's going into effect. This is based on a 1995 California court decision which affected that market with a decline in market availability.
If the economy maintains its current pace, this specialty niche can provide excellent returns for your efforts. However, if a recession were to occur, collections and audits would become a concern. Another situation occurs when jobs begin to dry up and payrolls have to be met and material bills are due. Some contractors have a tendency to step outside their realm of knowledge and capabilities. Framers become bridge builders, concrete finishers try their hand at being electricians, and plumbers become roofers to pay the bills. This increases the exposures to the carrier and, until audit--if at all, proper premiums are not collected. (This may not be a concern if competing banks continue to tear down and rebuild on the same site.)
Pricing, you ask? Never fear. The construction class is not left out of the price wars. That may create some concern regarding acceptability. MGA Richard McSweeny of the McSweeny Agency said, "As the market gets softer and the insured's require lower and lower premiums, some companies are increasing their underwriting standards. Accounts with losses may soon have difficulty finding a competitive quote." This may not be a rapid movement across the country, but some insurers recently have stated that they must divest themselves of unprofitable business.
