COUNTRYWIDE
1998 Multistate Commercial Auto Policy Program Changes
Mandatory coverage changes which apply to all five Commercial Auto coverage forms and broaden coverage include:
Loss of Use--Rental Vehicle Coverage which adds payment for expenses an insured may be legally obligated to pay to the rental or lease operation--up to $15 per day with a maximum of $450--for damages in a leased or rented private passenger-type vehicle only that is hired without a driver.
Limited Worldwide Coverage for Hired Autos for private passenger-type vehicles that are hired without a driver. If an insured rents or leases a private passenger-type auto for 30 days or less, anywhere in the world, there is coverage for damages that an insured incurs and is legally obligated to pay based upon a suit brought within the United States, its territories, possessions, Puerto Rico or Canada. There also is coverage for any settlement that the insurer agrees to.
Definition of Insured Contract has been amended (or added in the case of the Garage Program) to make it consistent and compatible with the similar definition found in the Commercial General Liability policy.

CA 20 56--Fellow Employee Exclusions For Designated Employees/Positions
Listed below, under the individual states, are those that have approved the above revisions. The text will not be repeated but will refer back to the specific Countrywide section.

ALASKA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after March 1, 1999.
ARIZONA
Commercial Auto Endorsement CA 21 39--Arizona Uninsured Motorist Coverage has been revised as a result of Ariz. Sess. Laws (former S.B. 1273) to clarify what is considered to be an uninsured motor vehicle by adding information regarding what corroboration is necessary for coverage. This change applies to all policies written on or after March 1, 1999.
ARKANSAS
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
The new, multistate Employment-Related Practices Liability Program has been approved for use. This change applies to all policies written on or after February 1, 1999.
CALIFORNIA
Optional additional new Multistate Year 2000 simplified professional liability endorsements have been approved. These changes are approved for ISO-approved insurers effective October 2, 1998.
COLORADO
The Personal Injury Protection coverage in the Personal Auto policy has been revised in order to comply with 1998 Colo. Sess. Laws (former S.B. 14). The Rejection of Work Loss section of Endorsement PP 05 61--Personal Injury Protection Coverage--Colorado has been amended to read that the work loss does not apply to the named insured and any family member, instead of any spouse. This change carries a distribution date of January 1999.

CONNECTICUT
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies effective on or after April 1, 1999.
DELAWARE
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
FLORIDA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies effective on or after April 1, 1999.
IDAHO
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
ILLINOIS
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
INDIANA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
IOWA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
KANSAS
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
Revisions have been made to Commercial Auto Endorsement CA 21 37--Kansas Uninsured Motorists Coverage in order to clarify the matching offer of subrogation procedures for underinsured motorist coverage and to comply more fully with Kan Stat Ann. 40-284(d). The law states that if more than one coverage or policy applies to a loss, the maximum amount recoverable is the highest applicable limit, regardless of whether primary or excess. These changes apply to all policies written on or after February 1, 1999.
KENTUCKY
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
MAINE
Optional Multistate Year 2000 new and/or additional boiler and machinery, commercial fire, commercial inland marine and commercial crime endorsements have been approved. These changes apply to all policies written on or after November 1, 1998.
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
MARYLAND
The new optional homeowners endorsement providing limited first- and-third party coverages for losses from escaped liquid fuel, HO 05 74--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverage, has been approved. Also approved is the dwelling liability equivalent. This change applies to all policies effective on or after March 1, 1999.
Two commercial auto endorsements have been revised to comply with 1996 Md. Laws 673 (former S.B. 604) and 1997 Md. Laws (former S.B. 474) which allow repair garages, dealers and rental facilities that offer replacement vehicles to fulfil motor vehicle registration requirements by classifying such vehicles as secondary instead of on a primary basis. The changed endorsements are CA 21 13--Maryland Uninsured Motorists Coverage and CA 22 19--Maryland Personal Injury Protection Coverage. These changes apply to all policies effective on or after March 1, 1999.
Similarly revised are Personal Auto Endorsements PP 01 68--Amendment of Policy Provisions--Maryland, PP 04 59--Uninsured Motorists Coverage--Maryland, and PP 05 81--Personal Injury Protection Coverage--Maryland. These changes apply to all policies effective on or after March 1, 1999.

MICHIGAN
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
The various general liability coverage parts advisory declarations pages have been approved for use in Michigan for all policies written on or after February 1, 1999.
MINNESOTA
The 1998 revisions to the multistate Commercial General Liability Program have been approved for use in Minnesota. These changes apply to all policies written on or after April 1, 1999.
MISSISSIPPI
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
MISSOURI
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
Optional revised multistate Year 2000 endorsements have been approved for use with boiler and machinery, commercial fire, commercial inland marine and commercial crime coverage forms. Optional new multistate Year 2000 endorsements have been approved for dwelling liability, homeowners and businessowners and simplified professional liability programs. These changes are applicable to all policies written on or after January 1, 1999.
Optional new or additional multistate Year 2000 endorsements have been approved for use with the Garage and Commercial General Liability coverage forms. These changes are applicable to all policies written on or after December 1, 1998.
MONTANA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
NEBRASKA
Interline Endorsements IL 04 15--Protective Safeguards and IL 01 64--Nebraska Changes--Appraisal have been revised to address the new structure of the Farm forms. These changes apply to all policies written on or after February 1, 1999.
NEVADA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
NEW HAMPSHIRE
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
The 1998 Multistate Interline Endorsement Revisions have been approved including a New Hampshire-specific supplement. These changes apply to all policies written on or after March 1, 1999.
The new, simplified 1998 Multistate Professional Liability forms and endorsements have been approved including New Hampshire Endorsement PR 01 47--New Hampshire Changes. These changes apply to all policies written on or after March 1, 1999.
The new, multistate Employment-Related Practices Liability Program has been approved for use. This change applies to all policies written on or after March 1, 1999.
NEW JERSEY
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
The multistate revisions to the 1991 Homeowners Program have been approved with state-specific amendments. These changes apply to all policies written on or after February 1, 1999.
NEW MEXICO
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after March 1, 1999.
The new, multistate Employment-Related Practices Liability Program has been approved for use. This change applies to all policies written on or after February 1, 1999.
NEW YORK
Optional additional multistate Year 2000 endorsements have been approved for use with the Commercial General Liability coverage forms. These changes are applicable to all policies written on or after December 1, 1998.
Optional new multistate Year 2000 endorsements have been approved for use with the Garage coverage form. These changes are applicable to all policies written on or after January 1, 1999.
NORTH CAROLINA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies effective on or after April 1, 1999.
Revisions have been made to Dwelling Liability Endorsement DL 24 60--Farmers Personal Liability Endorsement in response to the case North Carolina Farm Bureau Mutual Insurance Co., vs. Briley, N.C. App., 491 S.E. 2d 656 (1997) to redefine the definition of business. This change applies to all policies effective on or after February 1, 1999.
OHIO
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
OKLAHOMA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
OREGON
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
PUERTO RICO
The optional new multistate Year 2000 endorsements for business exposures in the Homeowners and Dwelling Liability Programs have been approved for all policies effective on or after February 1, 1999.
RHODE ISLAND
Commercial Auto Endorsement CA 21 43--Rhode Island Uninsured Motorist Coverage has been revised as a result of the decision in Rueschemeyer v. Liberty Mutual Ins. Co., 673 A.2d 448 (R.I. 1996) regarding the definition of uninsured motor vehicle and its relationship to government vehicles. Further revisions include changes to the Arbitration provision, Limit of Insurance provision and other revisions resulting from the 1993 Multistate changes. These revisions and changes apply to all policies written on or after April 1, 1999.
SOUTH DAKOTA
In response to South Dakota Bulletin 98-5, which makes clear that the appraisal and/or arbitration processes are not binding on either party, numerous commercial lines endorsements have been revised accordingly. The revised endorsements are:
IL 01 84--South Dakota Changes--Appraisal
BP 01 26--South Dakota Changes
CA 21 41--South Dakota Uninsured and Underinsured Motorists Coverage
CG 01 16--South Dakota Changes--Appraisal
CG 26 45--South Dakota Changes--Non-Binding Arbitration
In addition, changes made to Endorsement CA 21 41--South Dakota Uninsured and Underinsured Motorists Coverage delete the "competent evidence" requirement for hit-and-run accidents. These changes apply to all policies written on or after February 1, 1999.
TENNESSEE
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
UTAH
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
A new endorsement, CA 01 24--Utah Garage Liability Coverage Changes, has been developed and a number of existing endorsements have been revised with respect to the conditions regarding Who Is Insured and Other Insurance, to clarify for commercial auto coverage forms when and how a permissive user is covered under a business auto policy. The revised endorsements include: CA 01 59--Utah Changes, CA 21 62--Utah Uninsured Motorists Coverage, CA 22 44--Utah Personal Injury Protection, CA 31 06--Utah Underinsured Motorists Coverage and CA 01 24--Utah Garage Liability Coverage Changes. These changes apply to all policies effective on or after February 1, 1999.
VERMONT
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
In response to 1998 Vermont Laws 117 (former S.B. 185), Personal Auto Endorsement PP 04 96, Uninsured Motorist Coverage--Vermont has been revised with respect to the recovery provisions for uninsured motorists. Should an insured recover from a negligent party for losses covered by the insured's policy, the proceeds must be held in trust until the insurer has been reimbursed for the insurer's reasonable share. This change applies to all policies written on or after January 1, 1999.
WASHINGTON
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
WEST VIRGINIA
The 1998 Multistate Commercial Auto Policy Program Changes have been approved--refer to the Countrywide section above. These changes apply to all policies written on or after February 1, 1999.
WISCONSIN
