ISO FORM AND ENDORSEMENT CHANGES

Changes Made by Individual States

ALASKA

Commercial Auto Endorsement CA 21 60--Alaska Uninsured and Underinsured Motorist Coverage is revised to reflect the decision reached in State Farm Mutual Auto Insurance Co. vs. Harrington, 918 P.2d 1022 (Alaska Sup. Cr. 1996), where it was determined that the uninsured motorists coverage limit must be equal to the liability coverage limit purchased by the insured and that attorney's fees must be provided for as required under Alaska Civil Rule 82. Further, the definition of underinsured motor vehicle is revised to exclude the references to government vehicles along with other amendments to the definition and the endorsement.

Personal auto uninsured and underinsured motorist coverage endorsements also have been revised to include not only the above changes but also to respond to various laws, interpretations and clarifications made by the Alaska Division of Insurance. Amended endorsements include: PP 01 97--Amendment of Policy Provisions--Alaska, PP 03 42--Coverage For Damage To A Rental Vehicle--Alaska and PP 04 93--Uninsured/ Underinsured Motorist Coverage--Alaska. Both the commercial and personal auto changes apply to all policies written on or after October 1, 1999.

COLORADO

Two commercial auto endorsements have been revised in order to comply with 1998 Colorado Laws (former H.B. 1025) and 1998 Colorado Sessions Laws (former S.B. 14) and Colorado Regulation 5-2-6. They are CA 22 03--Colorado Personal Injury Protection and CA 22 61--Colorado Optional Basic Personal Injury Protection--Individual Named Insured. The revision clarifies that if the Work Loss benefit is rejected, the rejection applies to any resident relative. Other changes include specific options that the insurer must make available to insureds. These changes carry a distribution date of October 1999.

CONNECTICUT

The multistate Employment-Related Practices Liability Program has been approved with Connecticut-specific provisions. Additional Connecticut-only endorsements include: EP 01 07--Connecticut Changes and CP 28 05--Connecticut Changes--Supplemental Extended Reporting Period Endorsement. These changes apply to all policies effective on or after February 1, 2000.

The simplified multistate Professional Liability Program including state-specific supplement has been approved. These changes apply to all policies effective on or after February 1, 2000.

The optional, simplified, Professional Liability Program Year 2000 endorsements have been approved along with state-specific endorsement, PR 02 03--Connecticut Changes--Cancellation and Nonrenewal. These changes apply to all policies effective on or after February 1, 2000.

The multistate interline endorsement revisions have been made to IL 02 60--Connecticut Changes--Cancellation and Nonrenewal. These changes extend the endorsements' applicability to various new or additional lines of business. Approval applies to all policies effective on or after February 1, 2000.

GEORGIA

The Homeowners Endorsement HO 01 10--Special Provisions--Georgia has been amended to include a definition of collapse which clarifies that if any part of the interior of the dwelling separates from another and prevents the dwelling from being occupied for its intended use, it is considered to be collapse. Also included in this revision is the previously approved amendment to the expected or intended exclusion. These changes apply to all policies written on or after August 1, 1999.

MASSACHUSETTS

The new optional homeowners endorsements providing limited first- and third-party coverages for losses from escaped liquid fuel have been amended for clarity and so approved. Also approved is the dwelling liability equivalent. The amended endorsements include:

HO 05 72--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverages (All Forms except HO 00 04 and HO 00 06)

HO 05 73--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverages (HO 00 04)

HO 05 74--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverages (HO 00 06)

DL 24 58--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverages

DL 24 59--Rating Information--Property Remediation For Escaped Liquid Fuel And Limited Escaped Liquid Fuel Liability Coverages

This change applies to all policies written on or after November 1, 1999.

NEW HAMPSHIRE

The 1999 ISO Multistate Commercial General Liability Changes have been approved with the new mandatory endorsement addressing know injury or damage. Included in this revision is CG 25 07--New Hampshire Changes--Per Person Limits of Insurance--Governmental Subdivisions. These changes apply to all policies written on or after November 1, 1999.

NEW YORK

In response to the decision reached in Haber v. St Paul Guardian Insurance Co., 137 F.3D 691 (2nd Cir. 1998), two personal lines endorsements, HO 24 93--Workers' Compensation--Certain Residence Employees--New York and DL 24 15--Workers' Compensation--Certain Residence Employees, are revised. The revision amends the Who is Covered and Conformity To Statute provisions of New York's Workers' Compensation. These changes apply to all policies written on or after February 1, 2000.

NORTH DAKOTA

In order to comply with recent changes to ND Cent. Code, Sec. 4-35-09.1, two new endorsements have been developed: CG 26 56--North Dakota Changes--Notice of Cancellation--Pesticide Applicators (CGL) and CG 31 04--North Dakota Changes--Notice of Cancellation--Pesticide Applicators (OCP). Both of these endorsements are designed to provide insureds who are pesticide applicators with a minimum of 10 days' notice in the event of cancellation, termination or other modification of the general liability insurance policy. These changes apply to all policies written on or after October 1, 1999.

Homeowners Endorsement HO 01 33--Special Provisions--North Dakota has been amended with an editorial revision (quotation marks around the word "insured"). This change applies to all policies written on or after October 1, 1999.

SOUTH DAKOTA

The multistate Employment-Related Practices Liability Program has been approved with state-specific provisions. The additional South Dakota-only endorsement includes: EP 28 04--South Dakota Changes--Extended Reporting Period. These changes apply to all policies written on or after November 1, 1999.

The simplified multistate Professional Liability Program including a state-specific supplement has been approved. These changes apply to all policies written on or after November 1, 1999.

The multistate interline endorsement revisions have been made to IL 02 32--South Dakota Changes--Cancellation and Nonrenewal. These changes extend the endorsement's applicability to various new or additional lines of business. New IL 04 20--South Dakota Protective Safeguards endorsement has been introduced to make it clear to insureds that if protective safeguards are not maintained as required, the insurance policy will not respond. Approval applies to all policies written on or after November 1, 1999.

TENNESSEE

In response to 1999 Tennessee Public Acts 196 (former S.B. 1357), revisions have been made to Commercial Auto Endorsement CA 21 20--Tennessee Uninsured Motorists Coverage. The exclusion for vehicles owned by a governmental agency has been deleted from the definition of uninsured motor vehicle. This change applies to all policies written on or after February 1, 2000.

TEXAS

Two new endorsements have been developed and approved for use with monoline commercial glass coverage, and several prior endorsements no longer apply to monoline glass. In addition, the list of revised and updated glass forms and endorsements that may be used with commercial package policies in Texas have been updated.

New monoline glass endorsements: CP 01 56--Texas Changes--Glass and CP 02 04--Texas Changes--Cancellation and Nonrenewal Provisions For Glass.

Endorsements no longer applicable to monoline glass: IL 02 75--Texas Changes--Cancellation and Nonrenewal Provisions For Casualty Lines and Commercial Package Policies, CP 02 02--Texas Changes--Cancellation and Nonrenewal, and CP 01 42--Texas Changes.

The endorsements applicable to glass provided in commercial package policies include: CP 00 16--Texas Glass Coverage Form, CP 10 52--Broken or Cracked Glass Exclusion Form, CP 01 56--Texas Changes--Glass, and IL 02 75--Texas Changes--Cancellation and Nonrenewal Provisions For Casualty Lines and Commercial Package Policies. These changes carry a distribution date of November 1999. *
