The hospitality industry--the potential of hotels,
bars and restaurants

Although restaurants, taverns, and hotels are all different risks, they do share some of the same exposures. Restaurants and taverns even have the same SIC code, 5812 and 5813, eating places and drinking places. These are not the only similarities.

Liquor liability, cooking exposures, slip and falls and crime are all major concerns that the various elements of the hospitality industry share in common. Although not all restaurants serve alcohol, most hotels have a lounge/bar exposure along with cooking done on premises. Because the public comes in and out of all of these establishments, slip and falls can occur. Many restaurants and most hotels host large gatherings--from Christmas parties to conventions. This adds to the possibility of incidents that can turn into a claim. Additional areas and activities to monitor for hotel/motels include swimming pools, barber and beauty shops, gift shops, valet and limo services and entertainment. Resort hotels where guests can participate in trail rides, canoeing, golf, and tennis present concerns depending on whether the hotel is the provider or a vendor is involved. If there is an outside source, a certificate must be obtained and the business entity will need to be listed as additional insured or additional named insured with the vendor's carrier.

NBC's "Dateline" recently aired a segment about guests being robbed, beaten or sexually assaulted in their hotel rooms. In the cases shown, the inns' security and surveillance systems did not appear to function properly. This builds a good case for loss control prior to placing coverage for both the insurer and client; neither wants to pay out dollars in claims or higher premiums as the result of a major loss. If your carrier doesn't provide loss control services, you may want to offer that service to the insured on a fee basis.

While high cash exposures are prevalent in both the restaurant and tavern business, the hotel risk must address crime coverages for employee theft of patron property, money, and other goods. Carrying out background and reference checks when hiring employees will help minimize future losses.

Workers compensation carries a high loss potential because of the cooking exposures that exist in restaurants, taverns and hotels. Cuts, burns, and slip and falls top the list of occurrences for kitchen employees, while back injuries, eye, lung, or skin irritation and reactions are of concern for the maintenance staff. If the business performs its own lawn care, the handling of certain chemicals needs to be monitored.

eat1 Taverns, and restaurants that serve liquor face the problem of serving minors and intoxicated customers. If a tavern serves food, it, along with the restaurants, faces the risk of food-borne illness due to contaminated food products. Taverns and bars, particularly ones with entertainment, also have the exposure of assault and battery losses from employees who have the task of ejecting rowdy customers. Assault and battery is excluded on the majority of policies although it can be purchased separately as a buy-back.

Of the three risks, restaurants, especially new ventures, face an uphill battle for at least the first year. This period of time is financially critical to the future success of the business. One-third of restaurants will fail in the first year, half the second and after five years 80% will have gone out business or will have been sold. It important to obtain financial documents to satisfy your underwriter that your client is not included in those statistics.

We have addressed the major areas of concerns regarding loss control and underwriting. Now let's look at what the markets are doing. We received over 40 responses to our survey of the hospitality niche of specialty markets. This is a positive sign. For the most part, the market appears to be much the same as other lines of business in that some portions are showing signs of either tightening or firming. Capacity seems not to be an issue because many markets have responded that they have unlimited capacity if the risk qualifies from an underwriting standpoint. There does seem to be an exodus of carriers although not on a grand scale.

J. Scott Klein, president of Klein Insurance Services of Clifton, New Jersey, states that "more carriers are moving out than in" and "that is a change from the last five to seven years when carriers were moving into the market." Klein Insurance Services writes hotel and motel business in all 50 states. While the general liability remains soft, the property side is taking a different stance according to Klein. "Property rate increases are moving up on the coastal locations and moving inland; two major insurers are looking at 10% to 25% rate increases."

National Specialty Underwriter, Inc., is a program manager specializing in the hospitality industry. It offers general liability, umbrella/excess, property, crime, boiler and machinery, workers compensation, and EPLI. NSU uses purchasing groups, created by the Risk Retention Act of 1986, to group together individual hotel accounts into groups, which are characterized by the same market segmentation employed by the hospitality industry.

Chris Randall, president of NSU, says, "By concentrating individual accounts in groups, we are able to offer a more stable product and greater services from our companies. This means that there is a greater credibility of pricing which leads to greater long-term stability. We still allocate pricing to individual accounts based on their risk characteristics and loss experience but can do so under a more stable environment.

"We have watched numerous insurance companies target the hospitality industry over the past 10 years. They will invariably under-price the product in an effort to justify their efforts and then dramatically modify their risk selection and pricing. It appears we are nearing the end of this process with many of the large carriers. As companies start to pay more attention to underwriting results, we believe an opportunity is developing for a strong service market." NSU provides claims service along with underwriting services.

Randall states that with insurance companies curtailing resources in services such as claims and loss control, fewer customers are able to enjoy consultative services as they did two to three years ago--even accounts with as much as $1 million in premium. "We are leveraging the volume of our entire book of business to either receive a higher level of service from our companies or supplement those services outside of the insurance companies.

"Some of the claim issues we see troubling hotels include building ordinance for property insurance, innkeepers liability, exceptions to the pollution exclusion, and third-party discrimination." Randall further states, "It may be a result of intense competition in a soft insurance market cycle, but we do see a considerable amount of under-valuation of property value. This may give insureds a lower premium, but chances are they are not fully aware of the consequences."

Randall comments that their largest losses come from liquor liability, assault and some unpredictable miscellaneous events.

Regarding pricing he says, "There does appear to be an overall firming of pricing in the market. Although the truly good quality accounts are pretty flat, the accounts with more difficult exposures or with poor claims experience are moving up far more than in previous years."

It would seem that the hospitality market is still a viable market to pursue. There does appear to be some firming although not across the board. This follows the pattern of other classes of business today.
