Commercial Crime and Fidelity Form Changes
The entire crime program has been rewritten. Gone are the ABC forms. New for ISO are employee theft, forgery or alteration, client's property and funds transfer coverages. Seven coverage grants (eight for government crime) have been combined onto one primary coverage form (CR 00), though one or more coverage grants can be excluded. Additional coverage grants can be added by endorsement. Most of the current endorsements remain the same but all are renumbered. New endorsements for existing coverages and new coverage grants have been added. Homeowners form changes
ISO has introduced a new edition homeowners program called the HO 2000. The HO 2000 will eventually replace the HO 91 program and includes both revised and new forms. ISO has filed the program countrywide with the earliest proposed effective dates beginning in December 2000. The new program includes formatting changes to improve an insured's ability to read and understand the forms. Following are some highlights of the HO 2000 Program.
HO 00 (primary coverage) forms changes include:
Under Definitions--revisions to the program definitions for "business" and "insured".
Under Section I, Coverage B--coverage now applies to other structures which an insured or a tenant uses to store business personal property, unless storing fuel.
Under Section I - Coverage C
* The $1,000 sub-limit has increased to $1,500 for securities, accounts (and similar property), watercraft, trailers, electronic apparatus and for theft of jewelry (and similar property).
* The $2,000 sub-limit has increased to $2,500 for theft of firearms.
* The $250 sub-limit has increased to $500 for business property located away from the residence premises.
* Business property and electronic apparatus occasionally used in business is still covered under Coverage C.
* The $200 sub-limit that applies to money and similar property now applies to cash substitutes such as scrip and smart cards.
* Coverage clarifications have been made regarding personal property away from the residence premises, property of others, platinum dinnerware, motor vehicle parts, and water or steam.
Under Section I - Coverage D--the automatic (minimum) limits have been increased for all forms.
Under Section 1 - Additional Coverages--coverage has been increased and/or revised for removal of fallen trees, electronic funds transfer cards and devices, loss assessment coverage, grave markers/mausoleums, the collapse peril, landlord's furnishings, and ordinance or law.
Under Section 1 - Perils Insured Against--revisions have been made regarding coverage limitations for vacant dwellings, smoke damage, coverage for property damaged to repair broken pipes, freezing, mold/rot, mechanical breakdown and damage from artificial electricity.
Under Section I - Exclusions--clarifications have been made to the exclusions for water damage, earth movement, intentional loss and governmental action.
Under Section I, Conditions--the limit for filing lawsuits has been increased to two years and the Other Insurance provision now accounts for service maintenance agreements.
Under Section II, Liability Exclusions--the motor vehicle exclusion clarifies the exception for owned, motorized golf carts, losses involving alleged negligent supervision, the exception for intentional injury/damage involving defending oneself or others, business and rental property and the exclusion now bars coverage for hovercrafts.
Under Section II, Additional Coverages--the daily loss of earnings limit is now $250 and the damage to property of others is now $1,000.

ALABAMA
Commercial Auto--Alabama Changes - CA 01 91 03 94 has been withdrawn; Alabama Uninsured Motorists Coverage - CA 21 59 09 00 has been approved for use by participating insurers with policies written on or after September 1, 2000.
In a 1990 case, Powell v. Blue Cross & Blue Shield of Alabama, 581 So. 2d 772 (Ala. 1990), the court ruled that an insurance company could not subrogate against a wrongdoer until the insured was fully compensated for damages. Policies were changed to reflect the Powell decision.
The change in the Uninsured Motorist form is a result of the court case State Farm Fire & Cas. Co. v. Hannig, 2000 WL 46161,_2d_(Ala. 2000). In Hannig, State Farm was not allowed to subrogate against the wrongdoer because the insured had not been wholly compensated for the loss. A $250 deductible had been applied. State Farm appealed and the Supreme Court of Alabama reversed the lower court and negated the Powell decision at the same time. The court reasoned that no tortfeasor should be allowed to escape responsibility for an act simply because an insured has not been fully compensated.
Item 3 of the Transfer of Rights of Recovery Against Others to Us in the Uninsured Motorists endorsement has been changed to eliminate the reference to full compensation of the insured before subrogation can commence.
ALASKA
General Liability--A number of mandatory endorsements have been approved for use by participating insurers for policies written on or after September 1, 2000.
The Insurance Services Office introduced mandatory endorsements to its Commercial General Liability (CGL) program which clarify that coverage is not provided for injury or damage known to the insured before the policy inception. The need for these endorsements stems from a 1995 California Appeals Court decision known as "Montrose." ARKANSAS
Commercial Lines--Arkansas Changes IL 01 63 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
Also approved were changes to language to reflect the 2000 crime policy changes in IL 01 99 03 00 - Arkansas Changes - Transfer of Rights of Recovery Against Others to Us.
CALIFORNIA
Commercial Lines and Crime--Commercial crime and fidelity program changes referred to in the Countrywide section have been approved for participating insurers' use effective December 28, 1999, and February 11, 2000.
California amendatory endorsements include:
CR 02 49 03 00 - California Changes Endorsement - which conforms the policy to California cancellation laws and defines actual cash value as cost to repair or replace at the time of the loss with like kind and quality less depreciation, deterioration or obsolescence.
CR 01 50 03 00 - California Changes - Escrow Agent - adds escrow agents to the definition of employee.
The following amendatory form was approved for use effective November 17, 1999.
IL 02 70 03 00 - California Changes - Cancellation and Nonrenewal--removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms.
DELAWARE
Commercial Lines--Delaware Changes - Termination Provisions Endorsement IL 02 37 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. The change eliminates wording dealing with pre-2000 crime policies.
Homeowners--Homeowners changes referred to in the Countrywide section have been approved for participating insurers for all policies written on or after January 1, 2001. Also approved was a revised version of HO 01 07 01 01 - Special Provisions - Delaware which has been extensively revised to reflect changes found in the new program.
FLORIDA
Commercial Lines--Florida Changes - Cancellation and Nonrenewal - IL 02 55 03 00 has been approved for use by participating insurers for all policies written on or after September 1, 2000. The change adds commercial crime to the cancellation and nonrenewal endorsement.
INDIANA
Commercial Lines and Crime--The following endorsements have been approved for use by participating insurers for all policies written on or after July 1, 2000.
IL 02 72 03 00 - Indiana Changes - Cancellation and Nonrenewal--removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms.
IL 01 58 03 00 - Indiana Changes--The change eliminates wording dealing with the previous crime policies.
CR 02 36 03 00 - Indiana Changes--amends cancellation language to comply with state law and amends the transfer of your rights of recovery against others to us to make it clear that subrogation is possible even if the insurer does not fully compensate the person/organization that suffered the loss.
IOWA
Commercial Lines--Iowa Changes - Cancellation and Nonrenewal - IL 02 76 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. The change removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms.
KENTUCKY
Commercial Lines--Kentucky Changes - Cancellation and Nonrenewal - IL 02 63 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. Commercial Lines and General Liability--The following interline and general liability endorsements have been approved for participating insurers for all policies written on or after August 1, 2000. Changes are the result of Kentucky law revisions in cancellations and nonrenewals. The following forms are changed:

Businessowners--Two endorsements have been approved for participating insurers for policies written on or after September 1, 2000.
BP 01 65 08 00 - Kentucky Changes is new. It was developed to comply with Kentucky code KRS 304.20-40 that limits an insurer's ability to cancel an insurance policy. Also, recently enacted House Bill 3 (2000) prohibits an insurer from denying coverage to an innocent coinsured if the loss arose out of a pattern of domestic violence or abuse and the person who caused the act is criminally prosecuted. The payment to the innocent co-insured is less any payments to any mortgagee or other secured party. Subrogation rights are not waived.
IL 02 63 08 00 - Kentucky Changes - Cancellation and Nonrenewal - has been revised so that it no longer applies to Businessowners policies.
MAINE
Commercial Auto--Maine Changes - CA 01 34 09 00 and Maine Garage Changes, CA 01 76 09 99 have been approved for use by participating insurers for policies written on or after September 1, 2000. Maine Insurance Rule Chapter 150 required that a form of drive other car coverage be added to all policies where a commercial vehicle was also personally used. Chapter 150 has since been repealed and the change to the endorsement eliminates the "drive other car" coverage language.
MARYLAND
Commercial Crime--Maryland Changes - CR 01 03 03 00 has been approved for use by participating insurers for policies written on or after September 1, 2000. Changes include state-mandated cancellation rules and the elimination of wording dealing with the previous crime policies.
MICHIGAN
Commercial Lines--Michigan Changes - Cancellation and Nonrenewal - IL 02 86 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. The change removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms.
MISSISSIPPI

MISSOURI

CR 01 28 03 00 - Missouri Changes (for crime policies) - revise the cancellation language to comply with state requirements and to increase the period an insured has to sue an insurer to 10 years. A similar endorsement CR 01 27 03 00 - Missouri Changes was approved for crime forms.
MONTANA
Commercial Lines and Crime--The following change endorsements have been approved for use by participating insurers for all policies written on or after August 1, 2000.
IL 02 43 03 00 - Montana Changes - Cancellation and Nonrenewal. The change removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms.
CR 02 18 03 00 - Montana Changes - revise the cancellation language to comply with state requirements and changes concealment, misrepresentation or fraud to make it clear that any of these misdeeds committed by any insured is not covered whether during the process of applying for coverage or otherwise.
Homeowners and Dwelling Liability--The following endorsements were changed to reflect the change in Montana laws (1999 Montana Laws 134, former House Bill 156) which requires an insurer that limits medical coverage to usual and customary or other "reasonable" standards must show the insured how that standard was calculated. The insurance department felt that this new law would also apply to the "reasonable" part of the medical payments coverage in the Homeowners and Dwelling liability forms. Therefore, the word "reasonable" has been removed and a new endorsement for medical payments has been produced for each policy. Both endorsements are available for participating insurers for policies written on or after October 1, 2000. The two new endorsements are:

NEBRASKA

NEW JERSEY

NEW MEXICO

Also approved was CR 02 48 03 00 New Mexico changes which modifies the cancellation and nonrenewal rules to meet state requirements.
Commercial Lines--New Mexico Changes - Property Claims Settlement in the Event of a Catastrophe - IL 01 78 03 00 has been approved for use by participating insurers for all policies written on or after August 1, 2000. The change eliminates the Crime Coverage Part from the endorsement.
NORTH CAROLINA
Commercial Lines--North Carolina Changes - Cancellation and Nonrenewal - IL 02 69 03 00 has been approved for use by participating insurers for all policies written on or after September 1, 2000. The change removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms. Changes in cancellation language to meet state requirements have also been made.
OHIO

Similar coverages have become part of the Crime 2000 forms. Other language changes have been made to better reflect the wording of the crime 2000 forms.
PENNSYLVANIA
Commercial Crime--Pennsylvania Changes CR 02 21 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
PUERTO RICO
RHODE ISLAND
Commercial Crime--Rhode Island Changes CR 02 37 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
Commercial Lines--Rhode Island Changes - IL 01 97 03 00 has been approved for use by participating insurers for policies written July 1, 2000. The change in this endorsement eliminates wording that deals with pre-2000 crime forms.
Also changed was IL 01 28 09 00 - Rhode Island Changes - Prejudgment Interest.
Commercial umbrella coverage has been added to the list of coverages the endorsement modifies.
SOUTH DAKOTA
Commercial Crime--South Dakota Changes CR 02 08 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
UTAH
Commercial Crime--Utah Changes CR 01 21 03 00 (Crime Policy) has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements. Other changes were made to remove language particular to pre-2000 crime forms. A similar endorsement for crime policies, CR 02 33 03 00 - Utah Changes, was also introduced.
Homeowners--Special Provisions - Utah - HO 01 43 09 00 has been revised and is available for participating insurers for policies written on or after September 1, 2000. Utah Senate Bill 190 (section 31A-21-105) permits insurers to deny first-party claims if an insured conceals information or makes any material misrepresentation that is intended to deceive or actually contributes to the loss. The Concealment or Fraud section of the endorsement has been changed to incorporate the rights of coverage denial that the new law gives companies.
VERMONT
Commercial Lines--Vermont Changes - Statutory Liability - IL 01 26 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. The change eliminates wording particular to pre-2000 crime forms.
Commercial Crime--Vermont Changes CR 02 14 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
WEST VIRGINIA
Commercial Crime--West Virginia Changes CR 02 44 03 00 has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements. Also approved was CR 01 05 03 00 - West Virginia Changes - Loss Payment.
WISCONSIN
Commercial Crime--Wisconsin Changes CR 02 45 03 00 (crime policies) has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
Also approved was CR 01 06 03 00 Wisconsin Changes (crime forms). The changes eliminate wording particular to pre-2000 crime forms.
Homeowners and Dwelling--In the case Tempelis v. Aetna Cas. And Sur. Co., 485 N.W. 2d 217 (Wis. 1992), the Supreme court found that the concealment and fraud condition of the homeowners policy was ambiguous as to whether the whole loss or only that part of the claim related to the misrepresentation was excluded. Changes in homeowners and dwelling state endorsements include clarifying the concealment and fraud provision and adding a failure to comply with a conditions clause which excludes coverage for a breach of promissory warranty only if it increases the risk of loss or contributes to the loss. The following Wisconsin endorsements have been revised for participating insurers for policies written on or after August 1, 2000:
HO 01 48 02 00 - Special Provisions - Wisconsin - concealment and fraud provision is revised. Failure to comply with a condition provision is added.
DP 01 48 02 00 - Special Provisions - Wisconsin - concealment and fraud provision is revised. Failure to comply with a condition provision is added.
DL 01 48 02 00 - Special Provisions - Wisconsin - concealment and fraud provision is deleted.
DL 25 48 02 00 - Special Provisions - Wisconsin - concealment and fraud provision is revised. Failure to comply with a condition provision is added.
WYOMING
Commercial Crime--Wyoming Changes CR 02 26 03 00 (crime policies) has been approved for participating insurers for all policies written on or after July 1, 2000. The endorsement amends cancellation language to meet state requirements.
Also approved was CR 01 08 03 00 - Wyoming Changes - Legal Action Against Us which gives the insured 4 years to sue the insurer from the date you discover the loss. Changes eliminate wording particular to pre-2000 crime forms.
Commercial Lines--Wyoming Changes - Cancellation and Nonrenewal - IL 02 52 03 00 has been approved for use by participating insurers for all policies written on or after July 1, 2000. The change removes the language in the heading that says: "* This endorsement does not apply to coverage provided for employee dishonesty (Coverage Form A), forgery or alteration (Coverage Form B), or public employee dishonesty (Coverage Forms O and P)." Similar coverages have become part of the Crime 2000 forms. Other language changes have been made to better reflect the wording of the Crime 2000 forms. *
