Today's headlines list multi-million-dollar employment practices liability settlements on an almost daily basis. A Wall Street brokerage settled a sexual harassment suit for $10 million. The federal government agreed to pay $508 million to settle a 23-year-old lawsuit where over 1,100 women were refused work because of gender. In 1996, Texaco agreed to pay $176 million in a race-discrimination case. In 1998, there were 40,000 employment practices liability lawsuits on the court dockets.
Yes, many of these lawsuits involve large entities which probably are not on your client or prospect list. But according to Phillip Hill, assistant vice president at Andersen and Murison, an MGA and surplus lines broker: "The chances of experiencing a lawsuit from an employee which exceeds $1 million is substantially greater than one from a customer, unless the business has a large premises auto exposure such as delivery or manufacturing firms." Hill explains that the small business does not have the resources to protect itself from such lawsuits. Normally, there are no general council or human resources departments to assist in hiring and firing of employees.
Bonnie North, EPLI underwriter for National Insurance Professionals Corporation in Poulsbo, Washington, says, "Everyone is interested in EPLI quotes but they're hesitant to spend the money to purchase the product. Insureds appear to view the coverage as a luxury rather than a necessity." North also comments that pricing remains stable. NIPC targets nonprofits, governmental, municipalities, schools and law firms for its EPLI products.
EPLI has evolved since its introduction. Originally only claims-made was available. Now, occurrence forms are prevalent. Prior and intentional acts were not readily considered for coverage in all policies. Defense costs had inside limits only. It was rare to see limits in excess of $1 million; now $25 million and higher is commonplace depending on the class of business. Coverage was available only for legal costs to defend against sexual harassment, wrongful termination, and age and racial discrimination. EPLI provides coverage for the legal liability for these types of acts.
EPLI products have enjoyed broadening of coverage, reduced rates and many other enhancements over the past several years. Duty to defend or non-duty to defend, third-party availability, stand-alone defense coverage, and the including of temporary workers are a few that make this an attractive product.
The types of businesses that can least afford to pay claims out of their own pockets are the very ones that are reluctant to purchase this product. Wrongful termination defense costs alone could put a small business owner in dire financial straits. The major corporations that do purchase this coverage could probably sustain a large settlement in addition to attorney's fees and still survive. (Maybe that foresight was a factor in their becoming a major corporation?)
Mike Komar of Charity First, a San Francisco-based underwriting manager that targets nonprofit organizations, states that non-profits have essentially the same EPLI exposures as for-profit companies. They have the same types of claims; namely, sexual harassment, discrimination, and wrongful termination. "Most people don't realize that over 80% of nonprofit claims are actually of an EPLI nature." Komar says that directors and officers who purchase D&O to protect their personal assets might find this very alarming. EPLI claims are on the rise for nonprofits according to Komar. "As more people become aware of their rights as employees, they are frequently resolving their problems via lawsuits." This same scenario applies to volunteers.
This situation is not limited to nonprofits. In this industry it doesn't take long for the legal system and employees who feel wronged by an employer to open the communication channels. When they pursue restitution, it does not matter if the company is a Fortune 500 or Sam's Tool & Die.
Although markets do exist, several classes are more difficult to place than others. These would include attorneys, staffing industry and the medical field.
NAS Insurance Services, an underwriting manager and Lloyd's correspondent, offers Tenant Discrimination Liability which offers discrimination, harassment and wrongful eviction. For defense only, Tenant Discrimination Legal Liability Reimbursement is available.
If possible, defense cost should be outside the policy limits. This prevents exhaustion of protection. Intentional prior acts, independent contractors, whistle blower and punitive damages where available should be included in the product offered to all clients. Good pricing and broader coverage make EPLI a bargain and a necessity.
