Looking at the hospitality industry, which--for this article--includes bars, hotels, brewpubs and restaurants, we find that the recent upward trend in pricing hasn't forgotten to make its presence known. Responses to our survey regarding the above classes of business show that markets are tightening in many ways.
Liquor liability is being pulled from some package policies. Carriers have tightened underwriting requirements. Our responses indicate that some markets require hard copy loss runs from the prior carrier for a five-year period. Other markets have withdrawn completely. Higher deductibles are being sought. In some instances policy enhancements are not openly available. Pricing is up, but most say that it is commensurate with current market conditions and remains very competitive.
Two years ago, when hospitality was the April Rough Notes specialty topic, we received comments such as: "Even accounts with claims are having an easy time getting excellent coverages. It appears more companies are writing these than ever before." While this was a good thing for the customers, it wasn't for the insurance industry.
Brad Brown, president of Middle Georgia Hospitality, said that over the last three to four years "some players tilted the market" with low pricing. Today some of these have pulled out of the market totally while others tried to correct past mistakes by raising rates 20% to 30% across the board. The end result was that they either didn't give the new pricing enough time to work or just gave up on the class, says Brown. MGH targets the "business travel" type of lodging that includes a limited "restaurants with liquor" exposure. Brown says that they are seeing rate increases of about 10% in their book of business. "We try to underwrite by underwriting the business, not by pricing."
Specialty Insurance has been underwriting hospitality accounts since 1984. Mel Watters agrees with Brad Brown. "Specialty Insurance feels that the hospitality market has been operating irresponsibly over the past decade and has deteriorated to where it stands today. This includes many national, regional, and local carriers being forced to close, withdraw, or seek major price increases in an attempt to strengthen their positions."
Watters states that Specialty Insurance resisted this downward spiral of pricing. "Our programs have been profitable and we continue to be the longest running market in the hospitality market."
Each of these types of businesses has specific needs although the hotel exposures may contain restaurant and bar facilities. Common to each risk would be general liability, excess liability, property, contents, EPLI, EDP, and workers compensation.
When placing bar and restaurant accounts, a few optional coverages deserve serious consideration. These include crime, mechanical breakdown, spoilage, and food-borne illness. In upscale establishments a fine arts schedule might be needed. Crime, especially employee dishonesty, will most likely be underwritten very carefully. Liquor liability is offered both as part of the package or on a monoline basis depending on the carrier.
Financials will be required, especially on restaurant submissions--half of which fail in the first year of operation. With the recent slow down of the economy more types of risks will be scrutinized as to their solvency status.
Rates in the property market are closing up with the liability market. In the case of coastal properties the situation is magnified in both underwriting and pricing.
Like other small business, the hospitality industry faces a challenge in finding adequate coverage in catastrophe-exposed regions throughout the United States, according to Greg Butler, senior vice-president of International Catastrophe Insurance Managers (ICAT). "While government operated underwriting pools may provide some relief, business owners that access pools are generally offered policies that exclude or limit vital coverages with inadequate policy limits." Butler states that ICAT focuses exclusively on providing comprehensive coverage to coastal businesses. "The ICAT program offers both building ordinance and business income coverage and provides up to $15 million per location. We estimate that 30% of our business comes from the hospitality industry."
Chris Randall, president of National Specialty Underwriters, has watched numerous insurance companies target the hospitality industry over the past 10 years. Randall says that due to the fallout in the hospitality industry, most accounts can expect to see their rates rise. For some the increase will moderate, but others will see enormous premium hikes. "There are fewer risk control and claims representatives," says Randall. "Many customers are not able to enjoy the consultative services they did two or three years ago. This applies to accounts that may be paying as much as $1 million in premium."
According to Randall, general liability also is a major concern. "Fifty percent of our GL claims are trip-and-fall related," he states. Public exposures are greater if the hotel has facilities used by non-guests. Hotels with a bar, club or restaurant are prone to claims, not only by guests but also by patrons not staying on premises. These facilities also require adequate liquor liability coverage and careful loss control for these exposures. Innkeepers liability and third-party discrimination are unique issues associated with this business, according to Randall.
He also emphasizes that the swimming pool exposure requires special attention. Swimming pools can create problems with injuries ranging from life threatening to minor slip and falls in wet areas. A lesser-known issue is the use of chemicals and the inherent pollution exposure, as well as proper pool maintenance. "As underwriting criteria tighten in the firming market, hotels that can't provide adequate controls for their pools could face significant premium increases or limited coverage,"
says Randall.
"Ultimately, your claim cost will drive the cost of your insurance product. It follows that selecting a company that offers quality risk control will help hospitality clients gain the most value. The advantage to using a carrier that specializes in hospitality is that you're likely to find risk control programs that are designed with hotels in mind."
As the market firms--in not only the hospitality sector but also in most classes of business--specialty markets will become even more of a player in obtaining coverage for your clients. The number of standard markets participating in certain classes of business is dwindling. In order to bring their bottom line back into profitability some have opted to move out of classes of business even when certain risks within that class were claim-free for some years. Others have adopted very conservative underwriting guidelines, which is not conducive to large gains in new business growth. These actions may very well be the solution to that carrier's survival. In the meantime, retail agents must keep good existing clients and write new accounts to stay ahead of the competition. The specialty market is very much open for business.
More than 50 specialty entities responded to our survey and indicated that they are a market for all or part of the hotel, bar and restaurant industry. This is an increase of over 10% from last April's specialty article on this class of business. Note what states or territories each operates in.
