Commercial Property Coverage Part Changes
In January of last year, ISO filed a multistate revision of forms and endorsements applicable to the Commercial Property Coverage Part. The revisions are to the Coverage Forms, Causes of Loss Forms and endorsements. Homeowners Form Changes
ISO has introduced the HO 2000 edition of its homeowners program, which will eventually replace the HO 91 program; it includes both revised and new forms. ISO has filed the program countrywide with the earliest proposed effective dates beginning in December 2000. The new program includes formatting changes to improve an insured's ability to read and understand the forms. Commercial Liability Program Introduced
ISO has made a multistate change to its Commercial Program. Commercial umbrella liability coverage is now available for its participating companies to file independently. The program rules and forms are available effective November 1, 2000.
Listed below under the individual states are those that have approved the above changes. The text will not be repeated but will refer back to this Countrywide section.
Commercial Liability Umbrella--The program changes referred to in the Countrywide section have been approved for participating insurers for all policies written on or after April 1, 2001. In order to facilitate the program's use in Florida, it is being supplemented with the following forms:
CU 01 18 09 00 Florida Changes - Druggists

ILLINOIS
Personal Auto--PP 13 01 12 99, Coverage For Damage To Your Auto Exclusion Endorsement has been approved for use by all participating insurers for all policies written on or after January 1, 2001.
KENTUCKY
Commercial Property--The program changes referred to in the Countrywide section have been approved for participating insurers for all policies written on or after March 1, 2001.
MAINE
Dwelling Liability--Dwelling Program changes adopting the Personal Umbrella Policy (PUP) and state-specific endorsements have been approved. Forms DL 98 37 06 98, Personal Umbrella Liability Policy Amendment of Policy Provisions - Maine and the multistate endorsements are available with an edition date of June, 1998. The DL 98 37 amends the PUP in order to comply with the state's requirements regarding the program's approach to prejudgment interest, liquid fuel and lead liability exposures. MARYLAND
Dwelling Liability--Dwelling Program changes adopting the Personal Umbrella Policy (PUP) and state-specific endorsements have been approved. Forms DL 98 59 03 01, Personal Umbrella Liability Policy Amendment of Policy Provisions - Maryland and the multistate endorsements are available with an edition date of March 2001. The DL 98 59 amends the PUP in order to comply with the state's requirements regarding the program's approach to terminations and proof of mailing. MICHIGAN
Personal Auto--Michigan Forms PP 05 90 03 01, Personal Injury Protection Coverage - Michigan and PP 03 88 03 01, Amendatory Endorsement (Motor Homes) - Michigan have been approved for use by participating insurers for policies effective on or after March 1, 2001. PP 05 90 was revised to reflect the state's current maximum limit for Work Loss and Survivor's Loss benefits. PP 03 88 was revised to remove the schedule's reference to Covered Property Coverage.
MINNESOTA
Commercial Property, Farm--Interline Form IL 04 15 04 98, Protective Safeguards, has been approved and is available to participating companies for policies written on or after February 1, 2001. This form was revised to comply with the changes introduced with the recent multistate and state-specific farm forms (see following state entry).

The forms were revised in response to a court order that re-established the provisions of Regulation 68, which were in effect before February 1, 2000.
Commercial Property--The program changes referred to in the Countrywide section and state-specific form CP 01 33 10 00, New York Changes have been approved for participating insurers for all policies written on or after March 1, 2001. CP 01 03 was revised to amend the Duties in the Event of Loss and Appraisal Conditions.
Dwelling Liability--Dwelling Program changes adopting the Personal Umbrella Policy (PUP) and state-specific endorsements have been approved. The DL 98 35 and DL 98 89 amend the program's approach to excluding lead paint exposures. Commercial Lines--IL 02 44, Ohio Changes - Cancellation and Nonrenewal has been approved for participating insurers for all policies written on or after February 1, 2001. The form was changed to add a reference to the Commercial Liability Umbrella Program as a line of business.
OREGON
Commercial Lines--IL 01 39 03 01, Oregon Changes (Including Restrictions Or Abridgments) and BP 01 78 03 01, Oregon Changes (Includes Restrictions And Abridgments) have been approved for use by participating insurers for policies effective on or after March 1, 2001.The forms were revised in response to Oregon Revised Statutes 742.226. Specifically, the forms' Mortgage Clause was amended to include required wording to protect the interest of a mortgagee who has a financial interest in covered property, but which is not listed on the insurance policy. Note that, effective the same date, the reference to Businessowners was removed from IL 02 79 03 01, Oregon Changes - Cancellation And Nonrenewal Endorsement.
SOUTH CAROLINA
Commercial Property--CP 03 39 12 00, Windstorm Or Hail Percentage Deductible - South Carolina has been approved for use by participating companies for all policies effective on or after December 23, 2000. The form was changed to comply with S.C. INS REGS. 69-56 (2000). Specifically the form was changed to include mandatory wording that notifies insureds about the separate windstorm and hail deductible. Note that, effective the same date, CP 03 21, Windstorm Or Hail Percentage Deductible was withdrawn from use.
Homeowners--HO 03 17 12 00, Windstorm Or Hail Percentage Deductible has been approved for use by participating companies for all policies effective on or after December 23, 2000. The form was changed to comply with S.C. INS REGS. 69-56 (2000). Specifically the form was changed to include mandatory wording that notifies insureds about the separate windstorm and hail deductible.
TEXAS
Commercial Auto--The1997 and 1998 Multistate Forms Program have been approved. The program forms are currently available with a distribution date of March 2001. Note that the programs received approval once changes were made to make them equal to the coverage provided by the state's own program.
VERMONT
Dwelling Liability--DL 25 44 01 01, Special Provisions - Vermont and DL 98 93, Personal Umbrella Liability Policy Amendment Of Policy Provisions - Vermont have been approved and are available for use on or after January 1, 2001. The forms were changed to comply with 2000 Vt. Laws 91 regarding the program's approach to the state's recognition of civil unions.
Homeowners--HO 01 44 01 01, Special Provisions - Vermont has been approved. The form was changed in response to 2000 Vt. Laws (former H.B. 847) to reflect the insured status of a person of the same sex, who is part of a state-recognized civil union. This change is effective on or after January 1, 2001.
Personal Auto--PP 01 72 01 01, Amendment of Policy Provisions - Vermont and PP 03 80 01 01, Joint Ownership Coverage - Vermont have been approved and are available for use on or after January 1, 2001. The forms were changed to comply with 2000 Vt. Laws 91 regarding the program's approach to the state's recognition of civil unions.
WEST VIRGINIA
Commercial Auto--PA 02 35 12 00, West Virginia Changes - Cancellation has been approved for use by participating companies for policies written effective on or after February 1, 2001. The form was changed in response to Former H.B. 4650. Specifically the wording regarding policy cancellation was clarified.

The revisions involve the forms' approach to appraisal/arbitration, stipulating that the appraisal decision is binding on both parties but ONLY AFTER the parties have MUTUALLY agreed to arbitrating the amount of loss.
Homeowners--HO 01 47 11 00, West Virginia Special Provisions - West Virginia, has been approved for participating insurers for all policies written on or after December 1, 2000. This form was changed to comply with West Virginia Informational Letter No. 119A. The revision is to the form's Appraisal Condition, stipulating that the appraisal decision is binding on both parties but ONLY AFTER the parties have MUTUALLY agreed to arbitrating the amount of loss. *
