COUNTRYWIDE
Businessowners
In July 2001, ISO announced the 2002 edition of its Businessowners Program (BOP). The most substantial feature of the latest edition is the introduction of the BP 00 03 07 02, Businessowners Coverage Form. It takes the place of the long familiar BOP coverage parts (BP 00 01, BP 00 02, BP 00 06 and BP 00 09) because it is a complete form. It contains coverage provisions for property and liability protection, as well as all necessary policy conditions and exclusions. Other changes include:
* Modest expansion of coverage for the insured's landlord property
* Inclusion of exterior glass as component of covered property
* Limited coverage for computers and EDP equipment that is "stock"
* Clarifying how debris removal coverage applies
* Clarifying how collapse coverage applies
* Clarifying business income coverage and allowing for an extension of ordinary payroll coverage
* Offering broader coverage for:
- Money orders and counterfeit currency
- Increased cost of construction
- Business income from dependent propertie
- Expenses related to handling glass replacement
- Expenses related to recharging fire extinguisher systems
- Building property an insured newly buys or builds
* Clarifying the application of the Earth Movement exclusion
* Revising the Power Failure exclusion to provide limited coverage to computers and EDP equipment
The program also adds definitions such as "computer," "stock," "counterfeit," and "electronic media and records." There are a host of clarifications on the program's liability coverage, as well as some new and revised definitions. The program also offers new and revised multistate forms as well as a number of form withdrawals to conform with the latest edition's coverage intent and policy structure.
Commercial Automobile
ISO has introduced the following forms:
CA 23 37 01 02 - War, Military Action And Terrorism Exclusion
CA 23 38 01 02 - War, Military Action And Terrorism Exclusion - Garage Coverage Form
CA 26 14 01 02 - Amendment Of Single Interest Policy Provisions - War, Military Action And Terrorism Exclusion
These forms replace the policy's previous war exclusion language to create, essentially, an absolute exclusion against damage that is caused by military or terrorist actions. There is also a newly defined term, "terrorism."
Commercial General Liability and Commercial Liability Umbrella Changes I
ISO has introduced the following forms:
CG 21 69 01 02 - War Or Terrorism Exclusion (applies to CGL Coverage Part)
CG 31 42 01 02 - War Or Terrorism Exclusion (applies to OCP and Products/Completed Operations Liability Coverage Parts)
CG 31 43 01 02 - War Or Terrorism Exclusion (applies to UST Policy and Pollution Liability Coverage Part)
CU 21 29 01 02 - War Or Terrorism Exclusion (applies to Commercial Liability Umbrella Coverage Part)
These forms are options for barring coverage of both direct and indirect damage caused by military or terrorist actions, subject to the act involving either:
* Total property damage in excess of $25 million
* Serious physical injury or death to at least 50 persons
* The dispersal of nuclear, biological or chemical materials
The forms also include a newly defined term, "terrorism."

These forms are options for barring or limiting coverage of both direct and indirect damage caused by fungi or bacteria (e.g., mold). The limited coverage forms include a schedule for specifying an applicable, aggregate insurance limit and have a newly defined term, "fungi or bacteria incident." All of the forms also include a newly defined term, "fungi."
Commercial Lines
ISO is preparing the introduction of a new Capital Assets Program, which is a coverage concept that replaces its previous Manufacturer's Output Policy. The protection may be offered as a monoline policy or as a coverage part. ISO has also previously introduced a new Farm Umbrella Liability and Businessowner Program. In order to facilitate the new programs, ISO is offering the following new and revised multistate endorsements:

Dwelling Liability
In December 2001, ISO filed an optional endorsement. Form DL 24 71 04 02, Limited Fungi, Wet or Dry Rot, or Bacteria Coverage modifies the Personal Liability (DL 24 01) form to provide some coverage for damage caused by rot or fungus. Coverage is on an aggregate basis and is provided by adding a definition for "fungi," and changing the form's Limit of Liability provision to include BI and PD attributed to fungus or rot. The aggregate sub-limit of coverage does not add to the Personal Liability form's overall (Coverage L) insurance limit.
Farm Changes I
ISO has filed a multistate revision of endorsements applicable to the Farm Program. It has revised FL 04 44 12 01, Coverage For Physical Injury To Crops And Animals Due To Certain Crop Dusting Operations Performed By Licensed Independent Contractor By Aircraft (Limited Crop Dusting Coverage), FL 04 65 12 01, Farm Employers Liability And Farm Employees Medical Payments Insurance and FL 04 69 12 01, Custom Farming Liability Coverage. The changes are to comply with the National Association of Insurance Commissioners (NAIC) Statement of Statutory Accounting Principle no. 6. The principle requires that the due date for either audit or retrospective premiums must be referenced in a policy form. If it is not, any uncollected premium must be classified as nonadmitted premium income. These forms amend the applicable policy condition on audits by adding wording to the effect that any advance premium amount is a deposit, which will be verified by auditing at the end of each policy period. If additional premium is owed, the due date on any bill is the due date for paying audit premiums.
Farm Changes II
In July 2001, ISO filed a new multistate change to its Farm Program. The change was to introduce a Farm Umbrella Liability Policy and endorsements. Policy form FB 00 01 07 02, Farm Umbrella Liability Policy and its more than a dozen endorsements make excess coverage available. The following form protection is designed to supplement a standard farm and either a personal or commercial auto exposure. In some instances, coverage is provided on a drop-down basis. While most of the program's definitions and exclusions match the language found in most underlying forms, there are new ones that must be analyzed carefully to determine the scope of coverage. ISO's filing circular mentions that, as compared to its own Farm Liability form, the umbrella contains exclusion differences involving autos, contracts, intentional acts, pollution, employers liability, property damage, etc.
General Liability Program Changes
This program revision introduced the CG 04 37 Electronic Data Liability Endorsement which covers electronic data by adding a definition of the term and by modifying the property damage definition to include electronic data. The revision also editorially clarified the following:

Since the state's insurance authority has not disapproved the form, it becomes available per A.R.S. Sec 20-398 with an effective date of February 18, 2002.
Dwelling Liability--Form DL 24 08 01 02, Exclusion of War and Terrorism, is available for use by interested insurers. Since the state's insurance authority has not disapproved the form, it becomes available per A.R.S. Sec 20-398 with an effective date of February 18, 2002.

Homeowners--Form HO 05 16 01 02, Exclusion of Terrorism (With Limited Exception) And Exclusion Of War is available for use by interested insurers. Since the state's insurance authority has not disapproved the form, it becomes available per A.R.S. Sec 20-398 with an effective date of February 18, 2002.
Personal Umbrella--Form DL 98 29 01 02, Personal Umbrella Liability Policy War and Terrorism Exclusion Endorsement is available for use by interested insurers. Since the state's insurance authority has not disapproved the form, it becomes available per A.R.S. Sec 20-398 with an effective date of February 22, 2002.
CALIFORNIA
Commercial Auto--Form CA 21 54 02 02, California Uninsured Motorists Coverage - Bodily Injury has been approved and is available for use by interested insurers. The form was approved effective January 7, 2002. The form was modified in order to allow an exception required by state law. The change allows UM coverage to apply to an insured who is hit by a vehicle covered by his or her own policy, if that vehicle is being used in criminal activity (as long as
the insured is not involved with
the activity).
COLORADO
Commercial Auto--The program changes referred to in the Countrywide section have been approved for use by all participating insurers. The forms are available for all interested insurers with a distribution date of May 2002.

Personal Auto--Form PP 03 60 06 02, Safe Driver Insurance Plan - Connecticut has been approved for use by all participating insurers for all policies written on or after June 1, 2002. The form was changed to better conform with the state's Safe Driver Insurance Plan provisions.
DELAWARE

The forms were changed in response to a recent court decision (Kmonk-Sullivan v. State Farm). The definition of uninsured/underinsured motor vehicle was changed to remove an exception involving government-owned vehicles and equipment.

Homeowners--Form HO 05 17 01 02, Exclusion of War and Terrorism is available for use by interested insurers that successfully file proof of its need.
Personal Umbrella--Form DL 98 29 01 02, Personal Umbrella Liability Policy War and Terrorism Exclusion Endorsement is available for use by interested insurers. Note: Any interested insurer MUST make a separate filing of this form along with a proposed effective date and supporting information.
TENNESSEE
Commercial General Liability and Commercial Liability Umbrella Changes II--The program changes referred to in the Countrywide section have been approved for use by all participating insurers for all policies written on or after May 1, 2002.
TEXAS
Commercial Lines--Form IL 12 06 09 02, Texas Policy Changes has been approved for use by all participating insurers for all policies written on or after September 1, 2002. The form was introduced to meet the state insurance authority's preference for a state-specific form for making policy changes.
General Liability--The program changes referred to in the Countrywide section have been approved for use by all participating insurers. The forms are available for all interested insurers with a distribution date of May 2002.
UTAH

The forms were initially introduced in response to former House Bill 2970, which requires UM and UIM to be offered along with excess liability coverages.
Personal Auto--Form PP 13 01 12 99 - Coverage For Damage To Your Auto Exclusion Endorsement has been approved for use by all participating insurers for all policies written on or after May 1, 2002. The form was introduced as a state-specific form for clarifying how the personal auto policy responds to claims involving an auto suffering diminished value.
