With all of the pressure in the industry to show profitable growth, meet customers' needs, and find someone who wants your business, there is good news. There are facilities that want your EPLI business. They are even aggressively looking for accounts.

At the recent RIMS Conference held in April, many carriers and facilities were openly seeking employment practices liability business. The reason? A much better understanding of this coverage and how to underwrite the risk.

Salvatore Pollaro, senior vice president of Zurich's Employment Practice Group, says, "Underwriting has better data than 12 years ago." Pollaro explains that "Zurich has devoted 23 underwriters to this class of business alone. We share information--including jury verdicts--with our agent/brokers and the insured. This places an emphasis on communication." According to Pollaro, the market is good and they are adjusting to the current conditions. Currently pricing is up 25% to 30% and some add-ons now have a premium charge, as opposed to freebees of the past.

As are most markets, Zurich is targeting risks of 300 employees or less, offering $1 million limits on a primary basis with retentions of $5,000, $10,000, and $25,000.

Markets want your EPLI business. EPLI is more of a seasoned product, so are the underwriters who now have 12-plus years' experience. Fine-tuning of EPLI has made the carriers feel more comfortable after a broad scope of data was accumulated.

Tom Caputo, program manager of Rockwood Programs, states: "EPLI coverage was very difficult to place for franchisees in the past. Rockwood can now place this business with few restrictions. Third-party coverage is included in the premium pricing, which is very popular with the food service sector." Caputo says loss control is available via a HR Web site at no additional cost to the insured. The policyholder also has 30 minutes of free telephone counsel per month. Consulting prior to termination or demotion can result in cutting their deductible in half.

The target prospects are still employers with 250 to 300 employees or fewer. They also are the ones that don't always foresee the result of not adding this coverage to their insurance portfolio. The legal defense cost alone makes the premium worthwhile. What small employer has the expertise to run a full-fledged human resources department complete with an up-to-date employee manual? The problems lie not only in the everyday maintenance of the companies' manuals but also in adherence to the manual by both sides. Did the hiring process include an orientation and did the new employee sign that he/she understood the rules and policies? What if you did not hire an applicant? Will your reasons stand up in court? Employee files must be documented when any action takes place--positive or negative.

Employee complaints must be investigated. Too many are simply shoved aside. Incidents of this nature don't go away; they just go around and return. They can come back to harm the bottom line in a big way. In general, the smaller the business, the more likely it is that an EPLI claim would put them out of business if they have no coverage.

For large employers, the handling of EPLI claims, especially class action claims or claims with punitive damages exposure, can be the difference between a profitable and an unprofitable year, Tobin remarks.

According to Tobin, early claim intervention and early claim resolution are the keys to the success of an EPLI program. "Human resource profess-ionals and employment/labor attorneys have known for many years that the expedient handling of employment-related disputes, complaints and claims is essential in order to reduce the consequences and ultimate cost of alleged or actual wrongful employment practices," he says.

Five Star utilizes a specialty claims team comprised of experienced labor attorneys who handle nothing but EPLI claims. "In fact," explains Tobin, "the team has managed on average over 1,500 EPLI claims per year." He says that due to the number of claims seen over a year's period of time, the special team is able to quickly and effectively respond and resolve the claims promptly, helping keep down the overall cost to both the employer and the carrier. "If employers and their insurers can identify and respond to employment claims early, select/approve the right defense counsel and take advantage of alternate dispute resolutions, the claims handling process is more likely to be less traumatic and lower cost."

Most markets will steer clear of entertainment type risks; PEOs; governmental entities; auto, motorcycle, and boat dealerships; religious and political risks; health organizations such as hospitals; and law firms. If a market can place coverage on these classes of business, it will probably specialize in that class only.
