Specialty Lines Market Professional liability Capacity is abundant By Larry G. France The professional liability market, with few exceptions, appears to have an abundance of capacity as more markets throw their hats in the ring—driving down rates—and carriers provide more seminars to educate producers about their products. “Capacity continues to increase in the professional arena,” according to Chris Byson of United Brokers, Inc. “Evidence of this is the growing number of carriers creating programs to write professional liability products. The increase in capacity is creating a softening marketplace in which competition between carriers, wholesalers and agents is ever increasing. In an effort to stay ahead in this environment, companies are constantly adding new products and enhancing marketing tools.” Other support being provided by carriers, says Byson, includes educational material, printable documents and online quoting. In certain cases, “some are willing to provide assistance by sending company representatives to conventions or accompanying agents to appointments with clients.” John Whall of Euclid Managers says that rates for the technology and Internet market have seen significant deterioration over the past 12 months, but “at the same time coverage offerings have been expanding. Competition,” Whall says, “is heavy in both package and monoline markets.” Again, new markets are being aggressive and putting pressure on existing and established markets. “Increased capacity has significantly reduced the number of excess opportunities for middle market business,” states Whall. “The traditional media liability marketplace has stayed relatively stable.” Regarding architects and engineers, Brian Van Cleave of Euclid has observed “very aggressive competition for new business. Renewal pricing is lowering by 10% to 15% for accounts with the same exposures as expiring business.” Van Cleave has also seen an influx of new markets entering the marketplace in the past year that have been “very price competitive. Large firms continue to be priced at very competitive rate levels.” Van Cleave says that a few markets are increasing their rates, which creates some opportunities, but “these are the same markets that were well below the rest of the marketplace in the past years. Capacity has increased, although architects and engineers have not historically been buyers of high limits of liability much above $5 million.” “Professional liability for public entities has had several new entrants,” says Maria McGinn at Euclid. “These players generally have less than three years’ experience and target small to mid-size municipalities. While restrictions for risk classifications, budget size, limits of liability, and population are common, pricing has been more attractive. Surplus lines paper is offered by many markets, but experienced brokers and agents tend to seek admitted paper for their clients,” McGinn observes. McGinn says it appears that, because multiple companies are vying for the same customers, many are developing extra services to accompany their coverage. For example, loss control services are frequently offered at a minimal charge or sometimes free of charge. The professional liability market continues to grow with new professionals who are performing services that did not exist several years ago. As a result, potential markets are also growing, some in geographic areas that did not draw attention not so long ago. In Canada the growth is very rapid as the public becomes more aware of exposures, while at the same time the legal profession is becoming more involved with increased lawsuits. Some U.S.-based carriers and markets see that growth and have expanded their physical presence in Canada. “Markets that we may deem ‘regular’ P&C underwriters are widening their appetite and now writing more classes and in some cases brand new classes within the professional liability field,” says Hugh E. Fardy, vice president at CG&B Group in Markham, Ontario. “We have an influx of new capacity; most have experience in specific classes, but several aggressive markets have little or no experience in professional covers. In some cases, we are seeing new markets willing to write classes they have not even developed wording for.” Fardy also says that “the lack of experienced underwriting in professional liability is present in much of the market; and, as a result, we have a pretty constant rotation of staff throughout the various markets. “The desire for market share and new business volume continues to apply pressure on premiums, and at this rate we will approach the rate inadequacy of the ’90s very soon. Combined with increased claims activity, this will bring about the withdrawal of markets and the tightening of appetite once again. We all know that, but we can’t seem to help ourselves.” That observation applies to more than the professional liability class of business.
