Many tools to solve the client's needs

The Insurance Marketplace specialty lines directory lists 154 professions that have a need for professional liability coverage—not just tough medical malpractice risks and attorneys, but ones that everyone has in their marketing area. Examples include answering services, real estate agents, investment counselors, paramedics, and travel agents.

“The professional liability crisis presents a great market opportunity for agents to lock in clients on a long-term basis by providing and developing alternative risk solutions to help mitigate their clients’ spiraling cost of insurance,” says Sean Murray, president of Caitlin-Morgan.

Murray says that alternative risk mechanisms such as risk retention groups and captives offer a tremendous long-term opportunity for physicians, nursing homes and hospitals to gain control and manage their risk. “While the escalating costs for medical malpractice are often seen as an obstacle, the proactive agent can help guide clients toward alternative solutions that turn into opportunities,” he explains.

According to Murray, “In its simplest form, alternative risk transfer is focused on helping clients to retain risk through the establishment of their own insurance company. The retention of risk provides a measure of control to the client. Most alternative risk programs are able to provide unbundled services creating a competitive environment for claims providers that help to drive up service and minimize expenses.”

Murray says, “The leading complaint we hear from providers” of claims management services “is not ‘my price is too high’ but rather ‘my insurance company did not defend my claim properly.’ The defense and management of claims can be greatly controlled in an alternative risk solution with the physician or provider becoming an integral part of the claims management and decision-making process.”

This vehicle is not a “magic bullet” that will instantly reduce premiums, but it does give the client stable pricing and control of service.

We are seeing new and existing players going for growth and market share not only in the professional liability segment of the market but in other classes as well. The “underwriting discipline” that was the watchword in 2004 and into 2005 seems to have been replaced.

The soft market is beginning, according to Michelle Duffett, executive vice president of Insight Insurance Services. “The same underwriters, most at new insurers, are creating the problems. A long-term approach is sacrificed for immediate premium growth. We hope that the oversight of Sarbanes-Oxley will keep the market in check as outside actuaries and auditors refuse to certify overly optimistic projections,” she says.

Due to the many different types of occupations included in the professional liability market, there are many viewpoints and responses, with conditions varying from very soft to extremely hard.

Three areas of professional liability that receive a lot of attention are Internet/tech/media, architects & engineers, and public entities.

John Whall of Euclid Managers says that the media and Internet markets are stable. “There are pockets in the tech market where pricing is softening but in others, rates remain hard. In addition, new players are entering the tech market,” he asserts.

Regarding the architects & engineers segment, rate levels finished 2004 at an acceptable level, according to Brian Van Cleave of Euclid Managers. Van Cleave says that they are seeing some “rate pressure on ‘clean’ firms.… Price is always the leading concern but more brokers and buyers are becoming very knowledgeable about important coverage aspects of the A&E products being offered in the current market. Competition for the larger firms, with annual revenues above $5 million, is still fierce. There are very few firms in this market that are priced at a profitable level,” he says.

Linda Nelson of Euclid Managers paints the public entity market as having the “same strong players” with most of the new entries writing nonadmitted paper. “Pricing is competitive but not showing extreme swings or signs of the soft market approach,” according to Nelson. An emerging issue in this market, she says, is the increased use of DNA testing and wrongful conviction claims on older conventional claims.

Darwin Professional Underwriters’ markets are D&O and E&O liability for public and private companies, health care and medical professional risks and nonmedical professionals.

In the specialty lines market, Darwin continues to see that prevailing market conditions are satisfactory to allow profitable growth in its chosen lines and business segments. “We believe this to be especially true in nonmedical E&O, medical professional and various niche segments of the D&O markets,” says Paul Romano, senior vice president, underwriting. In the commercial D&O market, in general, price softening is slowing, he explains. “However, carriers are continually challenged to balance appropriate pricing strategy with coverage grants to achieve underwriting profitability. Evidence of some market share-driven pricing exists and has affected the desirability of this business to some insurers and reinsurers. This will put negative pressure on policyholders who are seeking a long-term, balanced approach to pricing their management liability coverage,” he continues.

The market is reasonably stable and does present many opportunities for increasing revenue and professionally satisfying the clients’ needs.
